In the Goods of William Waycott deceased.

Appeared personally James Matthews Chapple of the Parish of Ashburton in the County of Devon Organist one of the Executors named in the last Will and Testament of William Waycott late of Ashburton aforesaid House Carpenter deceased and made oath that the said deceased died on or about the Eighteenth Day of November 1844 and that he has made diligent search and due inquiry after, and in respect of the Personal Estate and Effects of the said deceased, in order to ascertain the full Amount and Value thereof; and that, to the best of his Knowledge, Information and Belief, the whole of the Goods, Chattels and Credits, of which the said deceased died possessed within the Peculiar Jurisdiction of the Dean and Chapter of Exeter (exclusive of what the Deceased may have been possessed of or intitled to as a Trustee for any other Person, or Persons, and not beneficially, but including the Leasehold Estates for Years of the Deceased, whether absolute or determinable upon Lives, and without deducting any Thing on Account of the Debts due and owing from the Deceased) are under the Value of One Hundred Pounds to the best of this Deponents Knowledge, Information and Belief.

This is the last Will and Testament of me William Waycott of the parish of Ashburton on the County of Devon House Carpenter who being weak in body but of sound and disposing mind memory and understanding do make publish and declare the same this thirtieth day of October in the year of our Lord one thousand eight hundred and forty four. I give devise and bequeath unto Frederick John Waycott Daw (son of Robert Daw of Ashburton aforesaid Tailor and Mary Ann his wife) my Clock. Also I give devise and bequeath unto William Henry Daw son of the said Robert Daw and Mary Ann Daw my large Testament. Also I give devise and bequeath all that my Messuage Tenement or Dwelling house Courtlage Gardens and Premises in which I now live situate in North Street in the said parish of Ashburton during the remainder of a term granted by lease (word obscured) by the late Peter Fabyan Sparke Esquire for fourteen years of which said term twelve years are now unexpired therein subject also to the conditions of the said lease as to Repairs and completing the building in the Courtlage. And also my Household Furniture consisting of the following articles to wit one bed and bedding, three tables, six chairs, Plate, Glass and other household Goods and Utensils unto William Waycott of Ashburton aforesaid Thatcher, James Matthews Chapple of the same place organist and John Baker of Ashburton aforesaid carrier their Executors Administrators and Assigns upon the Trusts following (that is to say) Upon trust to pay all my just debts and Funeral Expences and also Upon Trust that they my said Trustees do and shall on the said Frederick John Waycott Daw (son of the said Robert and Mary Ann Daw) attaining the age of Twenty one years assign or otherwise give the said Household Goods and Furniture before mentioned unto the said Frederick John Waycott Daw (son of the said Robert and Mary Ann Daw) but in the event of his dying before attaining that age Then I give devise and bequeath the same unto and amongst all and every the child and children of the said Robert and Mary Ann Daw and also of the several child and children of the said James Matthews Chapple and Sarah his wife on their respectively attaining the said age of Twenty one years subject neverthe less to the finishing and completing of the building in the Courtlage and the necessary repairs of the house (for which I have left sufficient wood for that purpose) and the Rates and Taxes thereof and the overplus if any I will and direct my said Trustees shall vest the same from time to time in a Savings Bank for the respective benefit of the said several before named children of the said James Matthews Chapple and Sarah his wife and also of the children of the said Robert Daw and Mary Ann his wife to be paid to each and every one of them on his or their attaining their respective ages of Twenty one years and in case of the death of any or other of them before attaining that age to pay and apply the same to the survivors or survivor of them. Also I will and direct that my said Trustees shall (word obscured) and suffer my granddaughter Mary Ann Daw (wife of the said Robert Daw) to live in the apartment she now occupies paying to may said Trustees or the survivors or survivor of them the annual rent of Two Pounds during the time she may occupy which said Sum of Two Pounds I will and direct shall be held by them Upon Trust for the use and benefit of the said several before named children of the said James Matthews Chapple and Sarah his wife and the said Robert Daw and Mary Ann his wife. And thereby declare that my said executors and Trustees for the time being shall not be answerable for each other or for involuntary lapses or misfortunes and that they shall be allowed to retain all their Costs and Expences to be incurred in the due execution of the Trusts hereby in them reposed. And I do hereby nominate and appoint the said William Waycott, John Matthews Chapple and John Baker Executors in Trust of this my Will. In Witness whereof I have to this Will set my hand and Seal the day and year first before written.
