This Indenture made the fourteenth Day of Aprill in the Thirtieth Year of the Reign of our Soveraign Lord George the Second by the Grace of God of Great Brittain France and Ireland, King Defender of the Faith, & so forth, and in the Year of our Lord, One Thousand Seven Hundred and Fifty Seven. Between John Ridd of Bratton Flemming in the County of Devon Yeoman of the one part, and Richard Radley of North-Molton in the sd. County of Devon Yeoman of the other part, Witnesseth, That whereas Hugh Fortescue of Filleigh in the said County Esqr. by his Deed Indented bearing Date the Twenty Second Day of November, in the Year of our Lord Christ, One Thousand Seven Hundred and fifteen, for the Consideration therein mentioned did grant, demise and Lease unto William Ridd father of the abovesaid John Ridd, and his Assigns, the Reversion of all and Singular those Fourscore Acres and half by estimation of Land & Pasture with the Appurtenances lying and being within the several Parishes of Challacombe Rawleigh and Kentisbury in the said County and called or known by the name of Thornford, whereof Forty Acres Parcell of the said Fourscore Acres and half are lying and being in the sd. Parish of Kentisbury, and Forty Acres and half residue of the said Fourscore Acres and half are scituate and lying in the said Parish of Challacombe, bounded on the East with certain Lands sometime heretofore in the tenure of Anthony Reyment, on the west with the Land sometime heretofore in the Tenure of John Ackland, on the South with certain Lands called Thornworthy otherwise Thorneland, and on the North with the Highway, All which said Demised premises were then in the Tenure & Possession of the sd. William Ridd his Assignee or Assigns, Under divers Exceptions and Agreements as by the sd. Indenture of Lease relation being thereunto had it doth more fully appear, To be had and holden all and Singular the said demised Premesis with the appurtenances, (except as is therein excepted,) unto the said William Ridd his Executors Administrators and Assigns for and during the time and Term of Fourscore and Ninteen Years, fully to be compleat and ended if William Partidge of the Parish of Challacombe Rawleigh & Thomas Ridd, who is since Deceased, son of the above named William Ridd or either of them so long shall happen to live, the said term to Commence and begin upon & immediately after the Deaths of the said William Ridd and one Humphry Ward, both since Deceased or other lawfull determination Yeilding and paying therefore Yearly after the Commencement thereof unto the said Hugh Fortescue his Heirs and Assigns the Rent of Four Pounds and Six pence of lawfull money at the four most usual feasts in the Year, Viz.t, The Nativity of St. John Baptist, St. Michael the Archangel, the birth of our Lord Christ, & the Annunciation of the blessed Virgin Mary, by equal portions during the said term, And then also yeilding and paying upon and after the several Deaths of the lives abovesaid, the Second best beast of the Person that shall be then Tennant of the said Premesis, or the Sum of Six and Forty Shillings and Eight Pence in lieu thereof, at the Election of the said Hugh Fortescue his heirs and Assigns for and in the name of an Herriot or Farlieve, And then also doing Suit and Service to all the Courts of the said Hugh Fortescue his Heirs and Assigns to be held and kept for and within the Mannor of East Ruckland in the said County upon reasonable warning during the sd. term Repairing also and maintaining all and Singular the said Premesis during the said Term, in which Deed Indented are several other Clauses, relation being thereunto had doth more fully & at large appear, And whereas the right Honble. Hugh Lord Clinton by his Deed Indented bearing date the Second Day of June, in the Year of our Lord Christ, One Thousand Seven Hundred and Twenty One, for the Consideration therein mentioned did grant Demise and Lease unto the above nam'd William Ridd and his Assigns the Reversion of all the abovesd. premises,To be had and holden unto the abovesd. William Ridd his Executors Admrs. and Assigns for and during the Term of Fourscore and Ninteen Years fully to be compleat and ended if Margaret the Daughter of the said William Ridd, now wife of the above sd. Richard Radley, so long shall happen to live, the said term to commence immediately after the Deaths of the abovenamed William Partridge and Thomas Ridd, or other lawfull Determination under the like Conditions as above recited in the said Indenture of Lease, relation being thereunto had doth more fully appearAnd whereas the abovenam'd John Ridd by virtue of the last will and Testament of the abovesaid William Ridd his father became lawfully possessed of one full Third part all the sd Premesis during the residue and remainder of both the abovesd. Terms,And whereas the right honble. Matthew Lord Fortescue by his deed Indented bearing date the Sixteenth day of September in the Year of our Lord Christ, One Thousand Seven Hundred and Fifty Three, for the Consideration therein mentioned did grant Demise and Lease unto the abovenam'd Richard Radley & his Assigns the Reversion of all the above said Premises,To be had and holden unto the abovesd. Richard Radley his Executors Admrs. and Assigns for and during the Term of Fourscore & Ninteen Years fully to be compleat & ended if George Radley Son of the said Richard Radley shallso long happen to live, the said term to Commence immediately after the Deathsof William Partridge & Margaret wife of the said Richard Radley aforesd. or other lawfull Determination under the like Conditions as above recited, in the said Indenture of Lease, relation being thereunto had doth more fully appear And whereas the said Richard Radley by his Indenture of Assignment bearing date the Seventeenth Day of September in the Year of our Lord Christ One Thousand Seven Hundred and Fifty Three, for the Consideration therein mentioned did Sell Assign and Sett over unto the said John Ridd his Executors Admrs. and Assigns, One full Third part of and in all the said Premises after the Commencement of the term last above recited, relation being thereunto had doth more at large appear.Now this Indenture Witnesseth that the said John Ridd for and in Consideration of the Sum of One Hundred Pounds unto him in Hand paid before the ensealing and delivery hereof, the receipt whereof is hereby acknowledged, Hath Demised granted Sold Assigned & sett over And by these Presents doth Demise Sell Assign & Sett over unto the said Richard Radley his Executors Admrs. and Assigns, the full One Third part of the abovesd. premises with the Appurtenances of which the said John Ridd is now lawfully possesed by Virtue of all the Deeds Indented above in part recited, or hereafter might be, on the Commencement of any, or either, or all the Terms abovesd. To have and to hold the said in part mentioned & recited premises with the Appurtenances unto the said Richard Radley his Executors Aministrators and Assigns for & during all the abovesaid Terms, (together with the sd. Indentures of Lease) in as large and ample manner to all intents and purposes as he the said John Ridd might or ought to have held & enjoyed the same by virtue of any and all the abovesaid Deeds, or otherwise howsoever, And the said John Ridd for himself his Executors, Administrators & Assigns doth Covenant promise and Agree to & with the said Richard Radley his Executors Admrs. & Assigns that he the said John Ridd hath at this present time full power good right & Lawfull Authority to Demise Sell Assign & Sett over the Premises hereby Demised in manner as aforesaid And that he the said John Ridd his Executors Admrs. or Assigns neither shall nor will at any time hereafter Sell Assign or Sett over sett or lett the premises hereby granted or any part thereof to any Person or Persons whatsoever, And the said John Ridd for himself his Executors Aministrators & Assigns doth hereby Covenant Promise & agree to and with the said Richard Radley his his Executors Admrs. & Assigns that He They or any or either of them shall & may Peaceably Use Occupy Possess and enjoy the Premises hereby granted without the hindrance or Molestation of him the said John Ridd his Executors Admrs. or Assigns or of any other person or persons lawfully claiming or to Claim the same by from or under him or any or either of them, In Witness whereof the Parties hereto have Interchangeably set their Hands and Seals to these Presents, Yeoven the Day and Year first above written.
