In the Name of God Amen
I Nicholas Warren of Rew in the County of Devon, gent, being sick of body but of sound and perfect mind and memory praised by the [effort] given unto Almighty God do make and ordain this my last Will and Testament in manner and form following. First, I comend my Soul into the hands of Almighty God who gave it hoping through the merrits death and passion of my Lord and only Saviour Jesus Christ to receive full and free pardon and remission of all my sins and to inherit everlasting life And my body I commit to the Earth to be decently buryed in a Christianlike manner at the discretion of my Executrix herein after named And as [ ] the disposition of such Worldly goods and Estate as it hath pleased Almighty God to bless me with in this life and make me Steward of. I do give devise and bequeath the same in manner and form following. First I give and bequeath unto my mother in Law, Anne Avery of Morchard-Crews in the county aforesaid widdow the sum of fifty pounds of lawfull money of England. Item, I do give and bequeath unto my brother in Law Robert Avery of the same parish, gent the Sum of one hundred pounds. Item, I do give and bequeath unto my sister in Law Mary Avery the sum of sixty pounds. Item, I do give and bequeath unto my sister in Law Elizabeth Avery the sum of sixty pounds. Item, I do give unto my sister in Law Anne Avery the sum of fifty pounds. Item, I do give unto my brother in Law John Avery the sum of fifty pounds. Item, I do give unto my brother in Law Richard Avery the sum of fifty pounds. Item, I do give unto John Russell of Silferton in the County aforesaid, yeoman the sum of two hundred pounds And also all the right title Estate and interest which I now have of in and to these fields call the P[ ] lying in the parish of Nethrex and county aforesaid. Item, I do give unto Symon Mills of Silferton aforesaid yeoman the sum of thirty pounds. I do give unto my mother Mellony Warren the sum of fifty pounds. Item, I give unto John White of [Batterleigh] in the county aforesaid Schoolmaster the sum of four pounds. Item, I give unto Thomas Cole of Netherex aforesaid yeoman the sum of four pounds. Item, I do give to Ann [See] Cheritonfitzpaine in the county aforesaid widdow the sum of five pounds. Item, I do give unto my servant Joane [Talby] the sum of five pounds. Item, I do give unto John Warren of Heavitree the sum of forty shillings all of which said legacys to be paid within six months next after my decease by my Executrix. Item, I do give unto William Warren the younger of Stoke Canon in the county aforesaid yeoman all that my messuages and tenement called or commonly known by the name of Popple House lying in the said parish of Rew, next adjoining the church house and all my right title estate and interest of in and to the same. Item, I do give devise and bequeath unto the poor of the parish of Rew aforesaid the sum of twenty shillings a year forever And to the poor of the said parish Stoke Canon twenty shillings a year forever. And to the poor of the said parish of Netherex twenty shillings a year forever to be bestowed in [ ]cloth not wider [ ] a yard and distributed yearly to them on the day called St. Nicholas Day according to the discretion of the Churchwardens and Overseers for the Poor for each parish for the time being which said several yearly [ ] my will is shall be paid by my Executrix [ ]ing the [terms] and Estate which Samuell Kingdom now hath of and in that messuage and tenement he now liveth in lying in the said parish of Rew. And from and after the expiration of such [terms] and Estate herein in my will is that all the said severall yearly [ ] of twenty shillings shall be paid out of the rents [ ] and profitts of the same messuage and tenements now in the possession of Samuell Kingdom forever more. And I do hereby bind and oblige the same p[ ] for the payment thereof in manner and form aforesaid. Item, I do give unto George Couch of [Edgley] five pounds. Any my will further is that if my now wife Joane Warren shall be with child at the time of my death then I do give and bequeath unto such child all that my lands in [ ] of the tenements now in the Possestion of the said Samuel Kingdom lying in the parishes of Rew and Thowverton during the term of his or her naturall life paying the said yearly [ ] in manner and form aforesaid. And if such child shall happen to die unmarried than my will is such lands shall remain and be unto my Executrix. But if such child shall be married and have issue lawfully begotten than I do give devise and bequeath the same lands unto the heirs of the body of him or her lawfully issuing forevermore. Item, I also give unto such child as aforesaid all those my fields or parcels of ground called the [Buckinghams] and Pryor [Barnfield] lying in the parish of Netherex and all my right title Estate and interest of in and to the same and every part and parcel thereof and also the sum of five hundred pounds. Item, I do give unto Nehemiah Dodge of Silferton aforesaid twenty shillings. All the rest residue and remainder of my Estate Lands and Tenements Leases Leasehold Estate goods and [chattells] rights and [ ] whatsoever not herein before mentioned to be given and bequeathed I do give devise and bequeath the same unto my dead and loving wife Joane Warren whom I do make and ordaine full and sole Executrix of this my Last Will and Testament. And I do hereby revoke and make void all former Wills and Testaments whatsoever by me made And I do desire my said brother Robert Avery and John Russell Symon Mills and John White to be my trustees and to be ayding and assisting to my said Executrix to set this my will performed according to the true intent of the same. In witness where of I have hereto set my hand and seal this Eleventh day of November in the twelfth year of the Reign of our Sovereign Lord King William the third now over England [ ] 1700.
