Richard Cridland of Topsham in the County of Devon. Mason, do make and declare this to be my last will and testament in the manner and form following. ____First I give & device & bequeath all my freehold & leasehold houses & lands situate lying and being in the parish of Topsham in the county of Devon or elsewhere, to my wife MARY CRIDLAND during the term of her natural life that is to say that my said wife shall receive have & enjoy for her entire use all the rents & profits of my said houses & lands during the term of her natural life & at her decease, I give device and bequeath the same as follows. I give and device to my son JAMES CRIDLAND all that dwelling houses with the appurtenances, now in my own occupation situated in the Fore Street, Topsham to have & to hold to my said son JAMES CRIDLAND his heirs & assigns forever. I give & device to my son RICHARD CRIDLAND the dwelling house with the appurtenances adjoining the one occupied by me & now tenanted by RICHARD HARRIS situated in the Fore Street of Topsham, to have & to hold to my said son RICHARD CRIDLAND his heirs & assigns forever. _____I give & devise to my son DANIEL HUNT CRIDLAND the dwelling house with the appurtenances adjoining the occupied by me & now tenanted by RICHARD HARRIS his heirs & assigns forever._____I give & devise to my son DANIEL HUNT CRIDLAND the dwelling house with the appurtenances now or late in the occupation of JOHN DART situated in the Fore Street, Topsham. Also I give & device to my son DANIEL HUNT CRIDLAND the dwelling house with the appurtenances adjoining the house occupied by the said JOHN DART now or late in the occupation of SAMUEL MULLETT to have & to hold to my said son DANIEL HUNT CRIDLAND the said dwelling house & appurtenances and to his heirs and assigns forever._____I give and device to my daughter ANN DRAKE the wife of ROBERT DRAKE the dwelling house with the appurtenances now all lately occupied by her situate in Higher Passage Lane, in the town of Topsham for her entire use & benefit during the term of her natural life but not for the use or profit of her present or any future husband & at her decease I give devise & bequeath the same to the then surviving child or children of my said daughter his her or their heirs and assigns for ever equally to be divided between them share and share alike. I give and devise to my daughter MARY MULLON the wife of HUGH MULLON (GARDNER?) the dwelling house with the appurtenances now or late in the occupation of MR NOSWORTHY Shipwright situated in Higher Passage Lane, Topsham. To have & to hold the same to my said daughter MARY MULLON her heirs and assigns for ever._____ I give and devise to my daughter ELIZABETH MATHEWS the wife of WILLIAM MATHEWS the dwelling house with the appurtenances now or late in the occupation of ABRAHAM COOPER situated in Higher Passage Lane, Topsham. To have and to hold the same to my said daughter ELIZABETH MATHEWS her heirs and assigns forever.____ NB. The houses with the appurtenances given at the decease of my wife to my sons & daughters as forsaid is subject to payment of an annuity of four pounds per annum being a charitable donation made by the late " Townson & Gibbs" to the poor of the parish of Topsham or is therefore my wish and request that the respective properties is given by me as forsaid bare their relative and fair proportions of the same I give devise and bequeath to my sons JAMES CRIDLAND and RICHARD CRIDLAND their heirs and assigns all my right life & interests in three dwelling houses with the appurtenances in the Fore Street of Topsham & now or late in the occupation of JOHN BROWN, SARAH UNDERHILL & JOHN HOLMAN the younger. Also two dwelling houses with appurtenances in Higher Passage Lane, Topsham now or later in the occupation of GEORGE WATTS & HENRY WATTS. Also three dwelling houses with appurtenances now or late in the occupation of THOMAS WEST, HENRY POTTER & JOHN HEALS situated in Monmouth Street, Topsham. Upon trust to keep the same in proper repair & pay out of the rents & profits they're of as follows, that is to say. To my daughter LEAH HUNT COOPER the sum of five pounds per annum, to my daughter MARTHA WILLS CRIDLAND the sum of five pounds per annum, to my daughter EMILY TOZER CRIDLAND, the sum of five pounds per annum. Another hereby charge the rents and profits of the whole of the dwelling houses with the appurtenances so given upon trust as aforesaid with the annual payment of the said sum of five pounds to each of my daughters & aforesaid their heirs & assigns for ever. I also give devise & bequeath to my sons JAMES CRIDLAND & RICHARD CRIDLAND all that my Messuages & tenements with the appurtenances which I jointly hold with MR HEZEHIAH MITCHELL by or under a lease from the Dean and Chaptor of Exeter commonly called Parsons Barn Court and all my estate, right, title, term and interest of & in the same premises with the appurtenances to have & to hold to them the said JAMES CRIDLAND & RICHARD CRIDLAND their executors, administrators and assigns to & for their own use & benefit equally between them share & share alike. I also give & bequeath to my sons JAMES CRIDLAND & RICHARD CRIDLAND the good will of my trade in Topsham, as allowed together with the scaffolding poles, ladders & such of the tools as may belong there to equally to be divided between them, as for all the rest residue & remainder of my said estate including my book debts, stock in trade consisting of tabs, lathes, timber, bricks & all the other materials which are comprised in such stock in trade and of what other nature or hind so ever the residue of my said estate may be. I give & bequeath the same to my said wife, MARY CRIDLAND, for her entire use & benefit, subject however, to the payment of my just debts, funeral expenses and the expense of proving my last will and testament and I hereby nominate and appoint my said wife MARY CRIDLAND, executor in trust of & to this my last will and testament. In witness whereof I the said RICHARD CRIDLAND have to this my last will & testament set & subscribed my hand this 27th day of January in year of our lord one thousand eight hundred and fifty five.______ RICHARD CRIDLAND _____signed by the said RICHARD CRIDLAND the testator as & for his last will and testament our presence who at his request in his presence & in the presence of each other we have subscribed our names as witnesses there to _____ The words & now _____tenanted by RICHARD HARRIS was added in the first page by the testator before the execution hereof ________HEZEHIAH MITCHELL Topsham_______

THIS IS A CODICIL added to my last will & testament baring date the 27th day of January one thousand eight hundred and fifty five. I give & devise to my son RICHARD CRIDLAND the garden now in my own occupation situated at the head of the court behind my said dwelling house to have & to hold the said RICHARD CRIDLAND his heirs and assigns for ever in witness whereof I the said RICHARD CRIDLAND have to this a codicil to my said last will and testament have set & subscribed my hand this 27th day of January one thousand eight hundred and fifty five_________________
