Licensed Victuallers 1776 - 1800

The following are transcriptions of the approval of Licensed Victuallers (Publicans), recorded under Quarter Sessions.

These are for the ‘North Shebbear and Hartland Division’, but are sometimes said to be the ‘Bideford Sessions’, even though Bideford was not included in this area.

The name of the person requesting a License is recorded, together with the person who agreed to stand as Surety for their keeping an orderly house.

The documents are housed in Devon Record Office (see reference number against each year).  Surviving documents start from 1728.  This batch covers 1776 to 1800.  (N.B: Pub names do not start appearing against licensees names unto c.1822 -  except for 1798, which helpfully did record the "Sign" of the House. ).

1775

Devon to wit.

Be it remembered that on the 6th day of September in the year of our Lord 1775 the severall and respective victuallers & their suretys came before us his Majesty's Justices of the Peace for the said county of Devon residing within and acting for the Hundred of Hartland and Shebbear in the said county of Devon and each of the said victuallers did acknowledge himself to owe to our Sovereign

Lord the King the sum of £10 a peice and the several suretys for them £5 a peice (and in case of the absence of the victualler then two suretys in the sum of £10 a peice) to be levied in their several goods and chattles lands and tenements.

Upon condition that if the severall Victuallers do keep good rule and order in their respective houses yards pursuant to the licenses to them now granted for one year in such manner as the law directs, then their respective recognizances to be void, otherwise to remain in full force.

Taken and acknowledged at Hartland aforesaid the 6th day of September 1755, before us: Paul ORCHARD, James HAMLYN.

1776

Be it remembered that on the 2nd day of September in the year of our Lord 1776 the severall and respective victuallers and their sureties hereinafter named came before us his Majesty's Justices of the Peace for the said county of Devon (residing and acting within for the North Division of Shebbear Hundred and the Hundred of Hartland in the said county and each of the said victuallers acknowledged themselves to owe to our Sovereign  Lord the King in the sum of £10 a peice and the several sureties for them £5 a peice or one surety in £10 and in case of the absence of the victualler then two sureties in the sum of £10 for each surety. To be levied on their goods and chattles lands and tenements.

Upon condition that the severall Victuallers do keep good order in their several houses yards and backsides pursuant to the licenses to them now granted for one year in such manner as the law directs, then their respective recognizances to be void, otherwise to remain in full force.

Be it remembered that on the 16th day of September 1777 the severall victuallers hereunder mentioned together with their respective sureties came before us his Majesty's Justices of the Peace for the said county of Devon acting within the Hundred of Shebbear North and Hartland in the said county and acknowledged themselves to be indebted to our Sovereign Lord the King the victuallers in the sum of £10 each and one sureties in £10 or two sureties in the £5 each, and in case of the absence of victualler then two sureties in £10 each to be levied on their respective goods and chattles lands and tenements to the use of our Lord the King.

Upon condition that the severall Victuallers do keep good rule and order within their respective houses yards and backsides pursuant to the ale licenses to them now granted by us for one year until the next general licensing day for the said Hundred of Shebbear North and Hartland in such manner as the law directs, then their respective recognizances to be void, otherwise to remain in full force.

Be it remembered that on the 10th day of September in the year of our Lord 1778 the severall and respective victuallers & their sureties hereinafter named came before us his James Hamlyn, Augustus Saltren Willett & Henry Stevens esq his Majesty's Justices of the peace for the said county of Devon acting for the North Division of the Hundred of Shebbear and Hundred of Hartland in the county aforesaid and each of the said victuallers did acknowledge themselves to be indebted to our Sovereign Lord the King in the sum of £10 each and their several sureties for them £5 each, of one surety in £10 or in case of the absence of victualler then two sureties in £10 each to be levied on their respective goods and chattles lands and tenements.

Upon condition that if the severall Victuallers do keep good rule and order in their respective houses yards and backsides pursuant to the licenses to them now granted for one year in such manner as the law directs, then their respective recognizances to be void, otherwise to remain in full force.

Devon.

Be it remembered that on the 2nd day of September 1779, came before us James Hamlyn and Augustus Saltren Willett esquires two of his Majesty's Justices of the peace acting within and for the hundred of Shebbear North Division and Hartland in the said county of Devon at Woolfardisworthy in the said Hundred of Hartland, the several victuallers with their respective sureties hereunder mentioned and acknowledged themselves to be indebted unto our Sovereign Lord the King, the victuallers in the sum of £10 each and two sureties in the sum of £5 each, or one surety in the sum of £10, and in the case of the absence of victualler the two sureties in sum of £10 each, to be levied on their respective goods and chattles lands and tenements.

Upon condition that if the severall Victuallers do respectively keep good rule and order in their several and respective houses yards and backsides pursuant to the licenses now to them severally granted for one year until the next General Licensing day for one year until the next General Licensing day for the said Hundreds in such manner as the law directs then their several and respective recognizances to be void, otherwise to remain in full force and virtue.

Taken & acknowledged at Woolfardisworthy in the County aforesaid the 2nd day of September 1779 before us Augustus Saltren WILLETT, James HAMLYN.

Be it remembered that on the 18th day of September 1780 came before us James Hamlyn and Augustus Saltren Willett esquires two of his Majesty's Justices of the peace acting within the hundreds of Shebbear North Division and Hartland in the said County of Devon, the several victuallers hereunder named together with their respective suretys and acknowledged themselves to be indebted to our Sovereign the King the several victuallers in the sum of £10 each, and two suretys in £5 each or one surety in £10 and in case of the absence of the victualler then two suretys in £10 each, to be levied on their respective goods and chattles lands and tenements to the use of our Lord the King.

Upon condition that if the said several victuallers do keep good rule and order within their respective houses yards and backsides pursuant to the licences now unto them granted for one year until the next general licensing day for the said hundreds in such manner as the law directs, then their several & respective recognizances to be void, otherwise to remain in full force.

Be it remembered that on the 5th day of September in the year of our Lord 1781 came before us James Hamlyn and Augustus Saltren Willett esquires two of his Majesty's Justices of the peace for the said county acting within and for the hundreds of Shebbear North Division and Hartland in the said County aforesaid At the House of John Maine known by the sign of the New Inn in the parish of Clovelly in the Hundred of Hartland, the several victuallers hereunder mentioned with their respective sureties and severally acknowledged themselves to be indebted to our Sovereign Lord the King the several victuallers in the sum of £10 each, and two sureties in £5 each or one surety in £10, and in case of the absence of the victualler then two sureties in £10  each of good and lawfull money of Great Britain to be levied on their respective goods and chattles lands and tenements to the use of our Lord the King his heirs and successors, if default shall be made in the condition hereunder written.

The condition that if the several victuallers do keep good rule and order in their respective houses yards and backsides for one year until the next general licensing day for the said hundred pursuant to the licences to them now granted in such manner as the law directs, then their respective recognizances to be void otherwise to remain in full force.

Taken and acknowledged at Clovelly in the said County of Devon the 5th day of September 1781, Augustus Saltren WILLETT, James HAMLYN.

Devon to wit.

Be it remembered that on the 17th day of September in the year of our Lord 1782 before us James Hamlyn and Augustus Saltren Willett esquires two of his Majesty's Justices of the Peace for the said County acting within and for the hundreds of Shebbear North Division and Hartland in the County aforesaid at the House of Catherine Chipp known by the sign of the White Pack House in the Town and Parish of Bideford in the Hundred of Shebbear North Division, the several victuallers hereunder mentioned with their respective sureties and severally acknowledged themselves to be indebted to owe to our Sovereign Lord the King the several victuallers in the sum of £10 each and two sureties in £5 each or one surety in £10 pounds, and in case of the absence of the victualler then two sureties in £10 each of good and lawful money of Great Britain to be levied on their respective goods and chattles lands and tenements to the use of our said Lord the King his heirs and successors if default shall be made in the condition underwritten.

The condition that if the several victuallers do keep good rule and order in their respective houses yards and backsides for one year until the next general licensing day for the said hundreds pursuant to the licences to them now granted in such manner as the law directs then their respective recognizances to be void otherwise to remain in full force.

Taken and acknowledged at Bideford in the county aforesaid the 17th day Sept 1782, before us: Augustus Saltren WILLETT, James HAMLYN.

Be it remembered that on the 17th day of September in the year of our Lord 1783 the severall and respective victuallers and their sureties hereinafter named came before us James Hamlyn and George Buck esquires two of his Majesty's Justices of the Peace for the said County residing within the hundred of Shebbear in the said County and acting for the North Division thereof and also for the Hundred of Hartland in the said County And each of the said victuallers did acknowledge themselves to owe to our Sovereign Lord King George the third the sum of £10 a peice and the several surety's for them £5 a peice And in case of the absence of the victuallers then two sureties in the sum of £10 for each surety to be levied on their several goods and chattles lands and tenements.

On condition that if the severall victuallers do keep good order in their houses yards and backsides pursuant to the licences to them now granted for one year in such manner as the law in that case directs then their respective recognizances to be void otherwise in force.

Be it remembered that on the 17th day of September in the year of our Lord 1784 the several and respective victuallers and their sureties hereinafter named came before us George Buck, Paul Orchard, James Hamlyn & Augustus Saltren Willett esquires four of his Majesty's Justices of the Peace for the said County acting for the North Division of the Hundred of Shebbear and also for the Hundred of Hartland in the said County of Devon, And each of the said victuallers did acknowledge themselves to owe to our Sovereign Lord King George the third over Great Britain etc the sum of £10 a piece and one surety in £10 for two sureties for them £5 a piece and in case of the absence of the victuallers then two sureties in the sum of £10 for each surety, to be levied on their several goods and chattles lands and tenements.

On condition that the several victuallers do keep good order in their houses yards and backsides pursuant to the Licences to them now granted for one year in such manner as the law in that case directs Then their respective recognizances to be levied otherwise to remain in full force and virtue.

Be it remembered that on the 11th day of September in the year of our Lord 1787 the several and respective victuallers and their sureties hereinafter named came personally before us George Buck, Augustus Saltren Willett and James Hamlyn esquire three of his Majesty's Justices of the Peace of and for the said County of Devon and acting for the North Division of the Hundred of Shebbear and Hartland Hundred in the said County And each of the said victuallers did acknowledge themselves to owe to our Sovereign Lord King George the Third the sum of £10 a piece and the several sureties for them £5 a piece. And in case of the absence of the victuallers then two sureties in the sum of £10 each to be levied on their goods and chattles lands and tenements.

Upon condition that if the said victuallers do severally keep good rule and order in their respective houses yards and backsides in such manner as the law in that case directs then their respective recognizances shall be void otherwise to remain in full force and effect.

Be it remembered that on the 19th day of September in the year of our Lord 1797 the several and respective victuallers and their sufficient sureties hereinafter mentioned came before us Paul Orchard esq, John Pine Coffin, Thomas Saltren and Hooper Morrison clerks four of his Majesty's Justices of the Peace for the said County and acting for the Hundred of Shebbear North and also for the hundred of Hartland in the said County And each of the said victuallers did acknowledge themselves to owe to our Sovereign Lord King George the third the sum of £10 a piece and the several sureties for themselves in £5 and in case of the absence of the said victuallers two sureties in the sum of £10 to be levied on their several goods and chattles lands and tenements.

Upon condition that each of the said victuallers hereafter named do severally keep good rule and order in their respective houses yards gardens or backsides pursuant to the licences to them now granted for one year in such manner as the law in that case directs then their respective recognizances to be void otherwise to remain in full force and effect.

1798

Devon.

Be it remembered that on the 18th day of September in the 38th year of the reign of his Majesty King George the Third the several persons hereunder mentioned personally came before us John Pine Coffin, Thomas Saltren, and Hooper Morrison esquires Justices of the Peace for the said County and acknowledged themselves to owe to our said Sovereign Lord the King the several sums of money mentioned against their names respectively, to be made and levied of their goods and chattles lands and tenements respectively, to the use of our said Sovereign Lord the King his heirs and sureties if they shall make default in the condition hereunder written.

The condition of this recognizance is such that whereas the several persons hereunder written are licences respectively to keep a common inn and alehouse for one year from the 29th day of this present month of September in the houses wherein they respectively dwell, if they shall respectively keep and maintain good order and rule and shall suffer no disorders or unlawful games to be used in their respective houses, nor in any outhouse, yard, garden of backside, thereunto belonging, during the said term, then this recognizance shall be void.

Be it remembered that on the 3rd day of September in the year of our Lord 1799 the several victuallers and their sufficient sureties hereinafter mentioned came before us Paul Orchard, John Clevland esquires and John Pine Coffin, William Walter & Thomas Saltren clerks of his Majesty's Justices of the Peace for the said County and acting for the hundreds of Shebbear North and Hartland in the said County and did acknowledge themselves to owe to our Lord King George the Third the sum of £10 a piece and the several sureties for themselves in £5, and in case of the absence of the said victualler two sureties in the sum of £10 to be levied on their several goods and chattles lands and tenements.

Upon condition that each of the said victuallers hereafter named do severally keep good rule and order in their respective houses, yards, gardens and backsides pursuant to the Licences to them now granted for one year in such manner as the law in that case directs then their respective recognizances to be void otherwise to remain in full force and effect.

Sept 3rd, 1799, taken and acknowledged before us: J P COFFIN, Thomas SALTREN, W WALTER, J CLEVLAND.
