  200. <p><span>Gentlemen</span></p>
  201. <p>Being unable to discover the original grants of the Parish lands and premises of Tedburne Saint Mary, amongst those shewn to me in the Parish chest, I am compelled to trace the trusts on which those lands and premises were originally given to the Parish, from subsequent deeds. The freehold Lands, appear to be held on a different trust from those held for the remainder of a Term of Two thousand years, and it will therefore be necessary for me to trace the trusts of each, distinctly</p>
  202. <p>First as to the freehold lands which consist of. -</p>
  203. <ol><li>Nine Acres with a right of way eight feet broad situate in Tedburne between the lands of Baldwin Fulford Esq. on the north and east parts, and the Lands of James White Esquire on the south part.</li>
  204. <li>The Houses and Edifices called the Parish House of Tedburne and all other the Houses and Edifices thereto adjoining and belonging.</li>
  205. <li>The Little Meadow lying between the Lands late of John Tuckfield Esquire on the west the Lands of Nicholas Holman on the south and the Highway leading to the Parish Church of Tedburne from a place called the Haven on the east and the Parish Church on the north.</li>
  206. <li>The House and Orchards in Upcott in Tedburne lying on the north part of Upcott aforesaid and the common Wall in Upcott aforesaid on the South and the land of s<sup>d</sup>. Baldwin Fulford on the north east and the lands of Murch on the north west.</li>

  209. this Book. The earliest deed relating to these lands which I discovered was made in the beginning of the reign of Elizabeth, but as it much obliterated by damp, I am unable to ascertain the exact year. It is a Lease granted by the then Feoffees to Gilbert Westington Warden of the parish church of Tedburne for twenty years.</p>
  210. <p> "To the uses and intents following that is to say that the said Gilbert Westington<br />
  211.  "warden of the said Parish Church of Tedburn for his time and his successors<br />
  212.  "wardens every one for his time shall yearly and quarterly have receive and take<br />
  213.  "the issues revenues and profits coming growing rising or increasing of the<br />
  214.  "premises or of any part therof and the best that by any manner of ways or means<br />
  215.  "can be made of the same and the same and every part thereof shall convert<br />
  216.  "employ and bestow as well in upon and about the reparations of the said Church<br />
  217.  "of Tedborn the maintenance of divine service there as also in and upon all and<br />
  218.  "every other thing and things necessary and behovable in and about the same<br />
  219.  "Church, when and as often as need shall require by the advice consent and<br />
  220.  "agreement of the more part of the Inhabitants of the said Parish.</p>
  221. <p>Other Leases appear to have been granted by the Feoffees to subsequent Wardens but the trusts are not in the same words. The earliest of these is in 1606 when the lands were granted to the then warden for twenty one years, upon the following trust in which it will be observed that the maintenance of Divine service is not mentioned. <span>(viz,)</span></p>
  222. <p> "Upon trust to apply the rents in and about and upon the reparations of the parish<br />
  223.  "church of Tedburne aforesaid as also in and upon all and every other thing and<br />
  224.  "things necessary and behoveable in and about the same church when and as often<br />
  225.  "as need shall require by the advice and consent and agreeableness of the more<br />
  226.  "part of the Inhabitants of the said parish.</p>
  227. <p>The earliest deed appointing fresh feoffees of the lands, which I observed, was in 1701; in which the trusts of the Lands are simply declared to be.</p>
  228. <p> "To and for the only proper use benefit and behoof and towards the repairing and<br />
  229.  "maintaining of the Parish Church of Tedburne Saint Mary aforesaid and to and for<br />
  230.  "no other use intent and purpose whatsoever -.</p>
  231. <p>A similar trust was also declared in the deeds appointing fresh trustees in 1742 and in 1773.</p>
  232. <p>In 1800 another deed, for the appointment of new Trustees was made when the language of the trusts of the previous deed was disused, and the following trust substituted - viz.</p>
  233. <p> "Upon trust for the benefit and advantage of the parish parishioners and inhabitants<br />
  234.  "of Tedburn Saint Mary afsd. And so as all and singular the said lands &amp;c and the<br />
  235.  "rents thereof &amp;c may from time to time and at all times for ever hereafter be<br />
  236.  "applied employed and disposed of in such and the same manner and to and for<br />
  237.  "such and the same ends intents and purposes as the same lands and Hereditaments<br />
  238.  "and the rents, issues and profits thereof respectively were originally given<br />
  239.  "designed and settled" -</p>
  240. <p>In the deed of 1824 appointing the present Feoffees, the trusts appear to have been copied from the last deed.</p>
  241. <p>The Commissioners of Charity in their report state the trust to be simply, the application of the rents towards the maintainance and repairing the Parish Church of Tedburne Saint Mary, giving as their authority the deed of 1742.</p>
  242. <p>The nonappearance of the original grant, and the varying language of the Deeds I have mentioned, involves the question of what is <u>realy the trust in some obscurity</u>; but I have no doubt that the deed of Elizabeth, both from the particular wording, and the nature of the deed itself, gives more of the original trust than either of the others, and that the Feoffees will be fully authorized in taking the trust of that deed for their guidance.</p>
  243. <p> </p>
  244. <p><u><span>Secondly</span></u>. As to <u>the Leasehold</u> premises which consist of</p>
  245. <ol><li>A void plot or parcel of ground called the Greenlane containing one acre of Land bounded with the Glebe Lands belonging to the Rectory of Tedburn aforesaid on the north and south and with a little Brook of water flowing to a place called Church Bridge on the east and a way leading from a place called the Haven unto the parish Church of Tedburn Saint Mary aforesaid on the west.</li>
  246. <li>A Cottage or Dwelling house with the appurtenances formerly in the Tenure or occupation of one John Arnell Bounded with the riding way leading from the Haven to the said Church on the west.-</li>
  247. <li>And also one other cottage or Dwelling House with the appurtenances formerly in the possession of one Stephen Palmer Bounded with the highway leading from Exeter to Okehampton on the south and the Glebe Lands belonging to Rectory and parish church of Tedburn Saint Mary aforesaid on the north, all which said premises are situate in the Parish of Tedburn Saint Mary.</li>
  248. </ol><p>I have not been able to discover the original demise of these premises or indeed any earlier deed than 1701. when new Trustees were appointed, and the trust was then declared to be. "To and for the only maintenance upholding and supporting of the Church of Tedburne Saint Mary aforesaid".</p>
  249. <p>In the deed appointing new Trustees in 1742 the same words are again used, but in 1806 the trust were thus declared.</p>
  250. <p> </p>
  251. <p> "Upon such trusts and to and for such ends intents and purposes as in and by the<br />
  252.  "said recited Indenture / being the original grant / are mentioned expressed and<br />
  253.  "declared of and concerning the same."</p>
  254. <p>The deed by which the present Trustees were appointed in 1824 was not with the Deeds shown to me but I have no doubt it follows the wording made in 1806. The comissioners of Charities in their report, state the trust of these Lands to be, for the maintenance upholding and supporting of the said Church giving as their authority the deed of 1742 and I should therefore advise the Trustees in the absence of further evidence to confine themselves to that trust.</p>

After examining the last years Acct. there appears to be a Balance of 34<sup>£</sup>-15<sup>s</sup>-8<sup>d</sup> in M<sup>r</sup> J<sup>no</sup> Wills' hand which the said Feoffees authorize M<sup>r</sup> Wills to turn over 33<sup>£</sup>-16<sup>s</sup>-2 ½<sup>d</sup> of the aforesaid Sum to pay the Years Account on the Churchwardens Book home to Lady 1834. - Leaving a Balance of 19<sup>s</sup>-5 ½<sup>d</sup> due to the Feoffees, which is to remain in M<sup>r</sup> Wills' hand until the next annual meeting.<br />
  534. The aforesaid Feoffees further agree to assist M<sup>r</sup>. Fulford in procuring Plans &amp;c for Erecting a Gallery in Tedburn Church And also for Leasing out Hackworthy Cross Cottages for three lives that shall be agreed on at a future meeting the Lease to be from Lady Day last. -<br />

John Taverner's offer of Ninety pounds for Hackworthy Cross Cottages for a Lease for 3 Lives subject to a yearly conventionary Rent of four shillings per Annum. M<sup>r</sup>. John Taverner to pay for the Lease. The Feoffees agree to pay one pound towards the said Lease. The Money to be paid at Michls. Next.</p>

He grees to erect a Gallery of good substantial Materials the front to be Wainscot, to seat the Church under the Gallery, and put in a sky light and complete the whole for the sum of 160£. The first payment of ninety pounds to be at Michaelmas next. The remainder to be by Instalments of Twenty pounds a Year, or sooner if the Trustees can make it convenient so to do.</p>

Messrs John Wills, John Stoneman and Samuel Hodge. After examining the last years Acount there appears to be a Balance of 43<sup>£</sup>..7<sup>s</sup>..11 ½d. The Feoffees agree to pay over of the above sum 23<sup>£</sup>..15<sup>s</sup>..7<sup>d</sup> to the Churchwardens Acct for the last year being their Disbursements for the year ending at Lady Day 1836. leaving a Balance of 19<sup>£</sup>..12<sup>s</sup>..4 ½d including M<sup>r</sup> Splatts arrears of 6<sup>s</sup> which is to be paid to M<sup>r</sup> Wills as soon as possible. The Balance to remain in M<sup>r</sup> Wills hand until the next annual meeting.<br />
  1286. It is agreed the Annual meeting for Receiving the Rents &amp;c shall in future be held on the second Monday in July each year.</p>

  1292. <p>The following is a Copy of a Feoffee Deed bearing date January 26th 1824.<br /><span><span>This Indenture</span></span> Tripartite made the Twenty sixth Day of January one thousand eight hundred and twenty four. Between William Strong the Elder of Drewsteignton in the County of Devon yeoman, John Wills of Tedburn Saint Mary in the County of Devon yeoman, William Strong the younger of Dunchideock in the said county Yeoman and William Browning of the said parish of Tedburn Saint Mary yeoman / the only surviving Trustees named in a certain Feoffment Deed bearing date the Thirteenth day of May in the year of our Lord, One thousand eight hundred and Six. of the first part, Thomas Wills of Dunsford in the said County yeoman of the second Part, and Baldwin Fulford the Elder of Great Fulford in the County of Devon Esquire, Baldwin Fulford the younger of the same place Esquire, Richard Hippesley Tuckfield of Fulford Park in the said County Esquire, John Henry Hippesley Tuckfield of the same place Esquire James Pitman of Dunchideock aforesaid Esquire, and John Langdon <sup>died 1831</sup> Robert Priston John Stoneman, and Samuel Hodge all of Tedburn Saint Mary aforesaid Yeomen of the third part.</p>
  1293. <p><span>Witnesseth</span> that the said William Strong the Elder, John Wills, William Strong the younger and William Browning as well in pursuance of the Trust reposed in them in and by the said Feoffment Deed as for the conveying assuring confirming and continuing the Lands and Hereditaments hereinafter mentioned. To such uses upon such Trusts and for such charitable or other ends intents and purposes as the same were originally given designed and settled and as are hereinafter mentioned expressed and declared of and concerning the same, Have and every of them Hath granted bargained sold aliened enfeoffed and confirmed and by these presents do and every of them Doth grant bargain sell alien enfeoff and confirm unto the said Thomas Wills his Heirs and Assigns All those their nine Acres, with their way of eight Feet broad with the Appurtenances situate lying and being within the aff<sup>d</sup> Parish of Tedburn Saint Mary between the Lands of the said Baldwin Fulford on the north and East parts and the lands of James White Esquire on the South part. Also all the Houses and Edifices there with the appurtenances called the Parish House of Tedburn S<sup>t</sup>. Mary aforesaid, And all other the Houses and edificies thereunto adjoining and belonging with their and every of their appurtenances. And also all that their little Meadow with the appurtenances lying there between the Lands late of John Tuckfield Esq. on the west part and the Lands of Nicholas Holman on the south part, and the Highway leading to the parish Church of Tedburn Saint Mary aforesaid from a place called the Haven on the East part, and the parish Church of Tedburn Saint Mary aforesaid on the north part. And also all that their House and Orchards in Upcott in Tedburn Saint Mary aforesaid with the appurtenances lying on the north part of Upcott aforesaid and the common wall in Upcott aforesaid on the south part, and the Lands of the said Baldwin Fulford on the north east part and the Lands of Murch on the north west part, and the reversion and reversions, remainder and remainders rents, suits and services of all and singular the said premises. And all the Estate right Title Interest use trust benefit property Claim and demand whatsoever of them the said William Strong the elder, John Wills William Strong the younger and William Browning, and each and every of them of in to or out of the said premises and every or any part or parcel thereof. To have and to hold the said nine acres and all and singular other the Lands and hereditaments hereby granted and enfeoffed or expressed and intended so to be with their and every of their rights members and appurtenances unto the said Thomas Wills his Heirs and Assigns, To the use of them the said William Strong the Elder, John Wills William Strong the younger, Baldwin Fulford the Elder, Baldwin Fulford the younger Richard Hippesley Tuckfield John Henry Hippesley Tuckfield, James Pitman John Langdon, Robert Priston John Stoneman and Samuel Hodge their Heirs and Assigns for ever / <u><span><span>Upon Trust</span></span> nevertheless and to and for the benefit and advantage of the Parish Parishioners and Inhabitants of Tedburn Saint Mary aforesaid</u> / and so as all and singular the said Lands and hereditaments so hereby granted and enfeoffed or expressed or intended so to be and the Rents issues and profits thereof resepectively may from time to time and at all times for ever hereafter be applied employed and disposed of in such and the same manner and to and for such and the same ends intents and purposes as the same Lands and hereditaments and the rents Issues and profits thereof respectively were originally given designed and settled. And upon this further Trust that when and as often as it shall happen that the said <u>William Strong</u> the elder <u>John Wills</u> William Strong the younger Baldwin Fulford the Elder. Baldwin Fulford the younger <u>Richard Hippesley Tuckfield</u> John Henry Hippesley Tuckfield James Pitman <u>John Langdon</u> <u>Robert Priston</u> John Stoneman and Samuel Hodge the present Trustees or any other such person or persons as shall hereafter from time to time be nominated or appointed trustees for or concerning the premises shall be dead or relinquish or release the aforesaid Trusts that then and as often as the Survivors or such Trustees for the time being shall be reduced by Death or otherwise to the number of <u>three persons</u> or within three Calendar Months next after the shall be so reduced grant convey and assure all and singular the said Lands Tenements Cottages Dwelling Houses and premises with their and every of their appurtenances unto such other persons as such surviving Trustees or the major part of them for the time being shall in that behalf nominate or appoint To hold to them and to their Heirs To the use of such surviving Trustees and of such other persons so to be nominated and appointed for such new Trustees as aforesaid and of their Heirs and assigns for ever under such and the same Trusts and to and for such and the same ends intents and purposes to which the same Tenements Cottages or Dwelling Houses Lands Hereditaments and premises and the rents issues and and profits thereof respectively were originally given <sup>and</sup> are hereby expressed and intended to be continued to be settled <span>To the intent</span> and so that the same tenements Cottages or Dwelling Houses Lands Hereditaments and premises with their and every of their appurtenances and the rents Issues and profits thereof respectively may from time to time and at all times for ever hereafter remain and continue settled and perpetuated as the same were originally given and designed to and for the benefit and advantage of the said parish Parishioners and Inhabitants of Tedburn Saint Mary aforesaid and to and for no other use intent <sup>upon</sup> no other trust nor for any other end intent or purpose whatsoever. And the said William Strong the elder John Wills William Strong the younger and William Browning do hereby for themselves severally and not jointly or the one for the other of them but each of them for himself his Heirs Executors administrators and Assigns covenant promise and agree to and with the said Thomas Wills his Heirs and assigns in manner following that is to say that they said William Strong the elder John Wills Wiliam Strong the younger and William Browning have not nor either of them hath at any time heretofore made done or committed or wittingly or willingly permitted or suffered to be done or committed any act deed matter or thing whatsoever, whereby or by reason or means whereof the said Tenements Cottages or Dwelling Houses, Lands Hereditaments and premises hereby granted conveyed or enfeoffed or expressed or intended so to be with their appurtenances or any part thereof now is are can shall or may be affected impeached charged or incumbered in any sort or manner other than and except all and every the Lease and Leases heretofore granted and still subsisting of and in the said premises or of any part or parcels thereof by them the said William Strong the Elder John Wills William Strong the younger and William Browning or in conjunction with their to Trustees or any of them for the Term or Terms of ninety nine years Determinable on the Death or Deaths of one two or three person or persons at the most monies and under the rents and services reserved in such Lease and Leases respectively which said rents are intended to pass by the presents and from henceforth to be paid to the Feofees hereby created a new as aforesaid their Heirs Executors administrators and assigns upon the Trusts and for the purposes aforesaid. <span>And Lastly</span> the said William Strong the elder John Wills William Strong the younger and William Browning Have and every of them Hath made ordained constituted and appointed and by these presents do and every of them doth, make ordain constitute and appoint and in their place and stead put John Holman and Richard Hodge both of Tedburn Saint Mary aforesaid yeomen their true and Lawful attorney and attornies severally or jointly for them and in their names to enter into and upon all and singular the said premises hereby granted bargained sold and Enfeoffed or expressed and intended so to be or any part thereof in the name of the whole and peaceable and quiet possession and seisin of the same premises or any part thereof in the name of the whole to take and being in such quiet and peaceable possession and seisin thereof to deliver the same over unto the said Thomas Wills or to his certain Attorney or Attornies in that behalf Lawfully authorized to take and receive the same to be had and holden according to the tenor form and effect of these presents. <span>To the Uses</span> upon the Trusts and for the ends intents and purposes hereinbefore mentioned expressed and declared of and concerning the same.
