The last will and testament of Richard
Yolland of Aishburton gent Impris I commit my soul into the hands of our
Almighty god and my body to ye Xian buryal. Item I give to the poor of
Aishburton three pounds Item I give unto my three sisters, that is to say Mary
Agnes and Anne Tony five pounds to each of them Item I give to my brother John Yolland
fortie shillings and to each of his children ten shillings apiece Item I give to my
brother Thomas Yolland five pounds to be paid him in twentie shillings an yeare Item
I give to Nicholas Gortlie five shillings Item I do give and devise unto my executors
hereafter named and to their heires all that one messuage with all and singular
appurtenances lyeing and beinge in the North side of Borough of Aishburton which
I late purchased together with other lands of William Horsham and Richard Preston
and all that messuage and garden near the great conduit in Aishburton aforesaid
and now or late in the tenancy or occupation of John Donband and also that one
barn and garden lying and beinge neare St Lawrence Lane and now in the
tenure or occupation of Johan Freind widdow to the intent and purpose hereafter
mentd (that is to saie ) to be by them sold and disposed for the payment of my debts and for
legacys as I have hereby given and to now so purpose or intent Item I give unto
the child that my wife Jane now great withall forty poundes to be by my executors
putt to the best role and benefit of the said child when it shall accomplish the age of
seven years Item I do devise unto my said wife all my lands and tenements not formerly
devised during such tyme as shee shall remain a widow. Item I give unto Richard
Yoldon twentie shillings Item I do appoint and ordaine Jane my wife and William
Yolland my brother to be executors of my last will and testament Item concerning
the disposition of my lande not formerlye devised during suche tyme as my now wife
shall take another husband or after her death wch shall first happen. I will and devise
my said lande to her issue and issues of this my body begotten and to his or their heires
And for default of such issues to my brother William Yolland and the heirs of his
bodie begotten And for default of such issues to my brother Thomas Yolland for
and during the term of his natural life And after his decease and after such
tyme to the said former ... before limited shall be determined to my brother
John Yolland and the heirs of his bodie begotten And for default of such issue to
the right heires of me the said Richard Yolland for evermore Item I do appoint
William Knowlinge, Christopher Caunter, John Caunter and Roger Caunter.

Memorandum The Codicil that out of the land formerley devised if shall
happen in the said Richard Yolland to dye without issue of one and twenty
years of my body begotten I will and devise so unto Jane my wife for the better
augmentation of her lyvlyhood all that messuage with appurtenances in
Aishburton and those of land now in the possession or occupation of
John Quinte or his assignes ... Mr Richard Yolland Gilbert Collyns, ...
