Certificate of Acknowledgement before Commissioners

These are to Certify that on the twentythird day of April in the year one thousand eight hundred and fifty three Before us Robert Tucker and Robert George Abraham Two of the Perpetual Commissioners appointed for the County of Devon for taking the Acknowledgements of Deeds by Married Women pursuant to an Act passed in the third and fourth years of the reign of His late Majesty King William the fourth instituted "An Act for the abolition of Fines and Recoveries and for the substitution of more simple modes of assurance" appeared personally Susanna the wife of John Waycott and produced a certain Indenture marked Aa bearing date the twentythird day of April one thousand eight hundred and fifty three and made between Lewis Venning of the first part the said John Waycott and Susanna his wife of the second part William Barons and William Lovecraft of the third part and Robert Dobell of the fourth part and acknowledged the same to be her Act and Deed And We do hereby Certify that the said Susanna Waycott was at the time of her acknowledging the said deed of full age and competent understanding and that she was examined by us apart from her husband touching her knowledge of the contents of the said Deed and that she freely and voluntarily consented to the same.

Affidavit made by one of the Commissioners

In the Common Pleas

Robert George Abraham of Ashburton in the County of Devon Gentleman one of the Commissioners mentioned in the Certificate hereunto annexed maketh oath and saith that he knows Susanna the wife of John Waycott in the said Certificate mentioned and that the acknowledgement therein mentioned was made by her the said Susanna Waycott and the certificate signed by this Deponent and Robert Tucker of Ashburton in the County of Devon Gentleman the other Commissioner in the said Certificate mentioned on the day and year therein mentioned at Ashburton in the County of Devon in the presence of this Deponent And that at the time of making such acknowledgement the said Susannna Waycott was of full age and competent understanding and that the said Susannna Waycott was intended to pass her estate in the premises respecting which such acknowledgement was made And that this Deponent further saith that he this deponent is not in any manner interested in the transaction giving occasion for such acknowledgement or concerned therein as Attorney Solicitor or Agent or as Clerk to any Attorney Solicitor or Agent so interested or concerned And this Deponent further saith that previous to her the said Susannna Waycott making the said acknowledgement he this Deponent enquired of her the said Susannna Waycott whether she intended to give up her interest in the estates in respect of which such acknowledgement was taken without having any provision made for her in lieu of or in return for or in consequence of her so giving up her interest in such Estates and that in answer to such inquiry she the said Susannna Waycott declared that provision was to be made for her in consequence of her giving up such her interest in the said Estates And this Deponent saith that before her acknowledgement was so taken he was satisfied and does now verily believe that such provision has been made by Deed and that such Deed has been produced to the said Commissioners And lastly this Deponent saith that it appears by the Deed acknowledged by her the said Susannna Waycott that the premises wherein she is stated to be interested are described to be in the parish of Broadhempston in the County of Devon
