Will of Humphrey Fugars, Yeoman of Minehead, Somerset

[Though written as Brampton in his will, a Chancery case of 1682/3 about Humphrey's property identifies it as being in Bampton, which is where his brother Francis and his nephew, both of whom are mentioned in the will, lived.]

In the name of god amen the six and twenty daye of Januarye in the yeare of our Lord god a thousand five hundred eighty seven, I HUMPHRYE  FFUGARS in the county of Somerset yeoman being of good and perfect memory do make my last will and testament in manner and form following that is to saye first I give and bequeath my soule to Allmighty god my maker and redeemer  And my bodye to Christian buriall.  Item I give to the poore people of Myneheede six shillings and eighte pence. Item I give and bequeath unto my eldest daughter JOANE FFUGARS  fifty pounds of good and lawfull money of England halfe a score of pewter bottells my second best brazen panne  and twoe candlesticks  to have all the fore said money and goodes at her age of twenty one yeares. Item I give and bequeath unto ELIZABETH FFUGASRS my second daughter tenne pounds of good and lawfull money of England halfe a score of pewter botells twoe candlesticks my second best bedd  bolster and coverlett to have all the saide money and goodes at her age of twenty one yeares.Item I give and bequeath unto RICHARD FFUGARS  my sonne  fifty pounds of good and lawfull money of England halfe a dozen of my best silver spoons, halfe a score of pewter bottells twoe candle sticks one brazen clock that came from Spayton .Item I give and bequeath unto the child that my wyfe nowe goeth  withall  thirteene pounds six shillings eighte pence of good and lawfull money of England to be paid unto my foresaid child at one and twenty yeares of age. Item I give and bequeath unto RICHARD FFUGARS  my sonne  and unto the heires of his bodye  lawfully begotten all my lands and messuages and tenements set lying and being within the burrows townes and parishes  of Brampton in the county of Devon and all houses edifices buyldings gardens orchards lands pastures feedings rents re---------  hereditaments whatsoever withall  and singuler the premises and theire appurtenances. And also all my lands houses and messuages in Watchet within the parish of St Decuman in the county of Somerset or ells where within the realme of England. To have and to hold the said messuages and tenements withall  and singuler the premises and their appurtenances unto my said son Richard and unto the heires males  of his body lawfully begotten for ever. And for want of heires male of his body unto the child that my wife now goeth  withall (if it be a man child unto the heires males  of his body lawfully begotten in manner and form aforesaid.) And for want of heires males of their bodies lawfully begotten I resigne and make it over to my brother JAMES FFUGARS and unto the heires males  of his body in manner and forme aforesaid paying unto my two daughters  JOANE  FFUGARS and ELIZABETH  FFUGARS twenty pounds apeece. And unto the child that my wife now goeth withall (if it be a woman child it shall have twenty pounds) And for wante of heires males of his body unto FFRANCIS FFUGARS the son of FFRANCIS FUGARS and unto the heires males of his body lawfully begotten paying unto the three daughters of HUMPHREY FFUGARS twenty pounds apeece.So for wante  of heires  males of their bodyes lawfully begotten it shall return back againe unto my daughters and unto the heires of theire bodyes forever.Item my will is that my executors and rulers or one of them shall make unto MITCHELL ROWE and WILLIAM ROWE or unto theire assigns a good sufficient lease in law of one tente (?) called or knowne by the name of Ball hill late in hands of Mr John Cawoodleigh (?) for twoe names to be nominated by the above named Mitchell and William or their assignes within the space of one yeare and halfe next after the feast of AllSaints last past before the date hereof for and during the terme of their naturall lives yielding(?) and paying therefore yearely forty shillings of good and lawfull money of England and twenty six shillings eight pence in the name of a heriott  or -------  Also my will is that if any of my foresaide children doe happen to dye before they be one and twenty yeares of age then his portion shalbe divided amonge the rest of my children by even and equal partes by my rulers And so as many of them as dye before they be one and twenty yeares of age theire parte shalbe divided amonge the rest in manner aforesaide. If my wife doe happen to marry before my children be of age then my rulers shall call the saide money and goodes oute of the hands of my executrix and rulers shall take counsell upon this my will and shall by their Learned counsel make this my will in suche forme and order that every article clause and sentence may stand in  effort by law according to the teno§ and true meaning of this my will and all the rest of my goodes moveable and unmoveable whatsoever not given nor bequeathed I give it and bequeathe  it whollye unto ALICE FFUGARS my wife whom I make my sole and lawfull executrix Also I doe appoint my brother JAMES FFUGARS and JOHN GILES of Stanton to be rulers and overseers to see this my will performed and kepte.
