This is the last Will and Testament of me Richard Hewish of Cheriton Fitzpaine in the county of Devon Tailor. First I give devise and bequeath unto my nephew John Hewish of Cheriton Fitzpaine in the county of Devon Tailor who is the son of my late brother Andrew Hewish my two Freehold Houses and Gardens with their Appurtenances situated in the Parish of Cheriton Fitzpaine in the county of Devon and now in my and his possession to hold to the said John Hewish during the term of his natural life and after the said John Hewish's decease I give the said Houses and Gardens with their Appurtenances unto Elizabeth Hewish his wife of Cheriton Fitzpaine in the county of Devon to hold to her the said Elizabeth Hewish during the term of her natural life and after the said John Hewish's decease and Elizabeth Hewish's decease I give the said Houses and Gardens with their Appurtenances unto Richard Hewish the oldest son of my aforesaid Nephew John Hewish of Cheriton Fitzpaine in the county of Devon to hold to him the said Richard Hewish his Heirs and Assigns for ever, except he the said Richard Hewish should happen to die without lawful issue then I give devise and bequeath the said Houses and Gardens with their Appurtenances after his death unto my nephew Thomas Hewish Son of my late Brother Andrew Hewish of Cheriton Fitzpaine in the county of Devon to hold the same unto the said Thomas Hewish his Heirs and Assigns for ever. Also I give devise and bequeath unto Thomas Hewish Son of my late brother Andrew Hewish the sum of fifteen pounds to be paid him by my Executor six months after my decease.

I also give devise and bequeath unto Martha Hewish (the widow of my nephew Richard Hewish) and now living in France the sum of Five Pounds to be paid her by my Executor six months after my decease. Likewise I give devise and bequeath unto Sarah Snow my niece (wife of John Snow) and now residing in Bristol the sum of Five Pounds for her sole and separate use independent of her husband to be paid to her by my Executor six months after my decease. Also I give devise and bequeath unto Richard Hewish Son of my nephew John Hewish of Cheriton Fitzpaine my Clock and Case and best Bed performed to be delivered to him immediately after my death by my Executor. I give devise and bequeath unto all the children of my late brother Andrew Hewish except his two sons Joh Hewish and Thomas Hewish the later of whom has already been given Fifteen Pounds by a prior clause in this my Will, the sum of Five Pounds each to be paid them within six months after my decease by my Executor. I also give devise and bequeath all the children of my late Brother John Hewish formerly of Exeter, except Sarah Snow (who has already been given Five pounds by a prior clause In this my Will) the sum of five pounds each to be paid them within six months after my decease by my Executor. Also I give devise and bequeath unto the three Children of my late Sister Mary Hewish formerly of Poughill in the County of Devon the sum of Five Pounds each to be paid them within six months after my decease by my Executor and it is my Will that all the aforesaid Legacies be paid free of Legacy Duty. All the rest residue remainder what is left of my Goods Chattels Estate and Effects of what kind or nature soever not herein before particularly given I give devise nd bequeath the same unto John Hewish my nephew son of the late Andrew Hewish of Cheriton Fitzpaine in the county of Devon To hold the same unto my said Nephew the said John Hewish of Cheriton Fitzpaine his Executors Administrators and Assigns for ever paying my just Debts Legacies and funeral Expenses whom I nominate constitute and appoint whole and sole Executor of this my Last Will and Testament at the same time nominating and appointing Isiah Body Gentleman and Samuel Pridham Gentleman both of Cheriton Fitzpaine in the County of Devon Trustees to this my said Will and Testament hereby revoking disannulling and making void all former and other Will and Wills by me made. In witness thereof I have to this my last Will and Testament set my Hand and Seal this Twelfth day of December in the year of our Lord one thousand eight hundred and forty nine.

Signed sealed published and declared by the above named Richard Hewish the Testator as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses. The words "the late" being added to the 5th line of the 3rd page of the Will previous to his and our signatures.
