In the Name of God Amen I John Luly of Crediton in the County of Devon Gentleman being of a sound and disposing mind memory and understanding do this eighth day of May in the year of our Lord one thousand eight hundred and twelve make this my last Will & Testament in manner & form following first I do desire to be decently buried at the discretion of my executrix in the Church Yard of the Parish where I may happen to die and as to my worldly Estate & Effects I give & dispose of them in the following manner I give & bequeath unto Tristram Cox of Crediton aforesaid Carpenter the sum of ffive pounds of lawful money of Great Britain to be paid him by my Executrix hereinafter named within three Calendar months next after my decease I give & bequeath unto my Nephew Henry Luly of Swansea in Wales an annuity or yearly Sum of ffive pounds yearly and every year during his natural life clear of all deductions whatever to be paid him by my Executrix out of interest arising from stock standing in my name in the three per Cent Consols I give & bequeath unto my niece Jenifer Luly who is my Executrix from and immediately after my decease eight hundred pounds stock in the three per Cent Consols being part of Eighteen hundred pounds stock in the said three per Cent Consols and now standing in my name in the books kept at the bank of England to and for her own sole & absolute use & disposal either to sell out or transfer the said eight hundred pounds stock as she shall think proper I also give & bequeath unto my said niece Jenifer Luly all the interest arising from the remaining thousand stock for & during her natural life, subject nevertheless to the payment of one clear annuity of ffive pounds a year to my nephew Henry Luly as aforesaid after the Decease of my said niece then I give and bequeath the said his Exors admors & assigns to & for his & their own use and benefit but if my said niece Jenifer Luly shall happen to survive my said nephew then and immediately after his Decease I give & bequeath the said thousand pound stock unto my said niece Jenifer Luly her Exors & assigns to & for her & their own use & benefit absolutely all the rest residue and remainder of my Estate and Effects whatsoever and wheresoever and of what kind or quality soever and not hereinbefore by me given and disposed of after payemtn of my just Debts legacies and funeral Expences I give the same & every part thereof unto my said niece Jenifer Luly her Exors admors and assigns and I do hereby nominate constitute & appoint my said niece Sole Executrix to this my last Will and Testament In Witness whereof I to this my last Will and Testament have subscribed my hand & seal the day & year first above written John Luly
