In the name of God Amen The six and twentithe daye of Marche One thowsande six hundred and fower I Nicholas Turbervile thelder of Crediton in the County of Devon gent being sick of bodye but of p[er]fect remembraunce, thanks therefore be given to almightie god doe make and ordeyne this my last will and Testament in manner and forme followinge, That is to saie, firste I give and bequeath my soule unto almightie god my onely maker and redemer, by whose onely merrits I truste to be saved, And my bodye to be buried in xr[ist]ian buriall accordinge as it shall please my Executrice hereafter named without all pompe charge or solempnitie Item I give and bequeath to the poore of the parish of Crediton the somme of twentie shillings of lawfull money of Englande to be distributed within the space of one yere next after my decease Item I doe give and bequeathe all my landes and hereditam[en]ts whereof I nowe stand seized either in possession or re[ver?]c[i]on of any estate of inheritaunce unto George Turbervile my seconde sonne and to the heires males of his body lawfully to be begotten, And for defaulte of suche yssue unto Nicholas Turbervile my Thirde sonne and to the heires males of his bodie lawfully to be begotten, And for defaulte of such yssue unto the right heires of me the foresaide Nicholas Turbervile thelder for ever Item I do give and bequeath unto the saide George Turbervile my seconde sonne the same hundred poundes lawfull money of England which Simon Leach my sonne in Lawe had of me for the preferment of the saide George in his service as an app[re]ntice, if the saide George shall be then livinge at the tyme when the same hundred poundes are limitted to be repaid by the saide Simon as by an obligac[i]on thereof unto me made by the saide Simon more plainly app[ear]eth And moreover I doe give and bequeath to my saide sonne George Turbervile Two hundred poundes more of lawfull money of England to be payed at the end of the terme of his app[re]nticehoode with the saide Symon if the saide George shall be then livinge. Provided alwayes and alsoe my will is That unlesse the saide George Turbervile doe procure and cause my executrice to be cleirely discharged of one obligac[i]on wherein I stande bounden to the saide Simon Leache in the somme of two hundred poundes of lawfull money of England for the true service of the saide George in his apprenticehoode w[hi]ch the said Simon, that then he the said George Turbervile shall nott have ne enioy the foresaide somme of Two hundred poundes last before unto him given nor any parte or parcell thereof Item I doe give and bequeath unto the saide Nicholas Turbervile my Thirde sonne the somme of two hundred and fiftie poundes of lawfull money of England to be paid to the saide Nicholas when he shall accomplish the age of twentie and one yeres, if he shall be then livinge, And my wyll is that in the meane tyme my Executrice shall paye unto him the saide Nicholas towards his maintenaunce yerelye at the fower most usuall feasts of the yere tenne poundes of lawfull money of England by even porci[o]ns quarterly to be paied Item I doe give and bequeath unto my daughter Joane Turbervile the somme of two hundred poundes of lawfull money of England to be payed unto her within one yeare and haulf a yeare next after my decease, And my wyll is that my Executrice shall pay unto her yearely at the fower principall feasts of the yeare the somme of eight poundes of lawfull money of England untill such tyme as my saide daughter, Jone shall receive the saide two hundred poundes Item I doe give and bequeath to my daughter H[o]nnour Turbervile the somme of Two hundred poundes of lawfull money of England, the same two hundred pounds to be paied unto her when she shall accomplishe the age of twentie yeres, if she shall be then livinge, And my wyll is that my Executrice shall nott pay unto her the saide Honnour any thinge for the use or interest of the saide Two hundred poundes soe longe tyme as the saide Honour shall remaine with my saide Executriceand bt her mayneteyned, But if the saide Honnour shall depart from my saide Eecutrice,Then my saide Executrice shall pay unto her yerely towardes her maintenaunce the somme of Eighte poundes of lawful money of England by even porc[i]ons quarterly to be paied untill such tyme as the saide Honnour shall receive her saide legacy of two hundred poundes And my wyll also further is that if any of my saide fower children namely George Turbervile Nicholas Turbervile Jone Turbervile and Honour Turbervile shall departe his, their, or her p[rese]nte life or lives before they respectively shall be capable or enabled to receive his, their, or her legacies in moneys before unto them given and bequeathed by vertue or force of this my will and Testament that then his their or her porc[i]on or porc[i]ons of money which shall soe departe this p[rese]nte life as aforesaide shall remaine to the survivor of them the foresaide George Nicholas Jone and Honnour to be equally devided and imparted betwene them Item I doe give and bequeath unto Charity Bishop the daughter and heire of John Bishop gentleman deceased the same litle silver boale p[ar]cell guilt which I lately bought of Christofer Easton Goldsmith and which is most commonly used for drincking of seck, the same silver bole to be delivered unto the saide Charity at the day of her marriage; if she dye before then the same to remaine to my Executrice, Item I doe give and bequeath to my daughter Katherine Leach nowe wife of Symon Leach one of my broade guilt silver boles Item I doe give and bequeath unto my godsonne Symon Leach the younger sonne of the saide Simon Leach and Katherine his wife the somme of five poundes of lawfull money of England to be paied unto him when he shall accomplish the age of twenty and one yeres And if the saide Simon Leach the younger shall dye before the saide tyme then the same five poundes shall remaine to my Executrice Item I doe give and bequeath to such of my servants as shall be be reteyned in my service by the yeare at the tyme of my death the somme of fortie shillings of lawfull money of England to be devided amonge them by the discrec[i]on of my Executrice. Item whereas Thomas Turbervile by the name of Thomas Turbervile of Bere Regis in the County of Dorset Esquire by a certaine Recognizaunce or wryting obligatorie of the nature of A statute staple taken and acknowledged accordinge to the statute late made and provided for the recov[er]y of debt before Sr Edmonde Anderson Knight cheif Justice of the common Plees bearing date the second day of July in the seaven and twentith yeare of the Raigne of our Late Soveraigne Ladye Queene Elizabethe did stande bounden and obliged to me the saide Nicholas Turbervile in the somme of One thowsande poundes of lawfull money of Englande to be payed as in the same statute staple thereof made more plainely appeareth, my will nowe is that Thomas Staughton Esquire his executors and administrators and the survivor of them and such persons as the survivor of them shall nominate and appointe Executors of his or their Testamente shall be of the saide statute onely and for noe more my sole and onely Executors, Anie thinge in this my p[rese]nte will and Testam[en]t conteyned or any nominac[i]on of anie other Executor or executrice hereafter by me to be nomynated or appoynted to the contrary thereof in any wise notwithstandinge and also to the saide Thomas Staughton and to his executors and administrators I doe by this my p[rese]nte will and testament give and bequeath the saide statute staple; Item I doe give and bequeathe unto my wellbeloved wief Charitie Turbervile the marriage and wardshippe of the body and landes of the foresaide Charitie Bishoppe daughter and heire of the foresaid John Bishoppe deceased. The Residue of all my goodes debts and cattells moveable and unmoveable quicke and dead nott before given nor bequeathed (my debts and legacies p[er]formed) I doe give and bequeath unto my saide wife Charitie Turbervile, whom also I doe make and ordeyne my whole and sole Executrice of this my last will and Testament, the foresaide statute staple of one Thowsande poundes before menc[i]oned onely excepted, And moreover I the saide Nicholas Turbervile doe by these p[rese]nts Revoke and disanull all former wills and Testamentes whatsoever heretofore by me made before the day of the date of this my p[rese]nte last wyll and Testament, And that they and every of them shall be utterly voyde frustrate and of none effecte, and none of them to be of anie validitye or force by onely this my p[rese]nte last wyll and Testamente. In witnes whereof I the saide Nicholas Turbervile thelder have hereunto sett my hand and seale even the the day and yeare firste above wrytten. Certaine Additions added by me the foresaide Nicholas Turbervile thelder to this my p[rese]nte will and and Testament Item I the foresaide Nicholas Turbervile thelder doe further give and bequeath unto the foresaid George Turbervile my sonne the somme of Two hundred poundes more of lawfull money of Englande, And my will is that in considerac[i]on thereof the foresaid George Turbervile shall stande bounden and obliged by his obligac[i]on in the somme of Two hundred poundes lawfull money of England unto Richard Turbervile my eldest sonne with Condic[i]on for the paymente of seaven shillings weekely towardes the maintenaunce of the saide Richard my sonne duringe the ioynt naturall lives of the saide Richard and Charity my wife and for noe longer time, Moreover I the foresaide Nicholas Turbervile thelder doe give and bequeath unto the foresaide Joane Turbervile my daughter One hundred poundes more of lawfull money of England over and above the legacies before unto her given, Condic[i]onally And if soe be that, the saide Jone my daughter doe marry and take to her husbande one mr Gilberte Keyte of London Suger Refyner, And moreover I doe give and bequeath unto Charity Turbervile the daughter of Richarde Turbervile my sonne And unto the two children of Stephen Hake my sonne in lawe begotten uppon the bodie of Elizabethe my late daughter deceased tenn shillings a peece Nicholas Turbervile. witnesseth to these Addic[i]ons aforesaide added the seavententh day of May One thowsand six hundred and five those p[er]sons whose names followe.
