Will of Elizabeth Pook, Widow of Culmstock

God’s Will be done this is mine. I, Elizabeth Pook of Culmstock in the county of Devon, widow, being weak of body but of a sound disposition, mind, memory and understanding do make, publish and declare this, my last Will and Testament. in manner and following (that is to say)

Firstly, I give and bequeath unto my son, Nicholas Pook, his Executors, Administrators and Assignees, all my Leasehold Estate wherein I now live, lying and being in the Manor and Parish of Culmstock aforesaid, together with the Indentures or Leases whereby I hold the same, to have and to hold the same and every part and parcel thereof, with the appurtenances unto him my said son, Nicholas Pook, his executors, administrators and assignees, from, and immediately after my decease for and during all the rest, residue and remainder of the term of years (determinable on lives) which shall be therein then to come and unexpired

Also, I give and bequeath to my said son, Nicholas Pook, his Executors, Administrators and Assignees, one Under Room and the Chamber over the same formerly belonging to Melhuishes, which said Room and Chamber I have now annexed to the house wherein I now live, – to have and to hold the said Under Room and Chamber unto my son, Nicholas Pook, his Executors, Administrators and Assignees from and immediately after my decease for and during all the rest residue and remainder of the term of years (determinable on lives) which shall be therein then to come and unexpired

Also, I give and bequeath unto my son, Richard Pook, his Executors, Administrators and Assignees all that Cottage or Dwelling house (except aforesaid Under Room and Chamber which I have herein before given to my said son Nicholas Pook), Orchard and Garden Plot late in the possession of Ann Melhuish, together with the Indentures of Lease and Writings, whereby I hold the same to have and to hold the same with every part and parcel thereof – with the appurtenances (except before excepted) unto him, my said son, Richard Pook, his Executors, Administrators and Assignees from and immediately after he shall have attained the age of twenty and one years, for and during all the rest residue and remainder of the Estate and term of years (determinable on lives) which shall be therein then to come and unexpired

Also, I give and bequeath unto my said son, Richard Pook, the sum of one hundred pounds of good and lawful money of Great Britain to be paid to him, my said son Richard Pook, by my Executor hereafter named when he shall have attained his age of one and twenty years. Whereas the greatest part of this said sum of one hundred pounds so given in this will to my said son Richard Pook is due and owing to me from several persons that are indebted to me. Now this my Will is that, if in case my Executor hereinafter named shall be forced to bring an Action for the recovery of the said money or any part thereof, then this my Will is that my said son, Richard Pook shall bear and pay an equal share or proportion of the charges my Executor of this my Will shall sustain thereby

And whereas my said son, Richard Pook is now in his Apprenticeship and there being now a remainder of a term of years yet to come and unexpired thereof. Now this my Will is, and I hereby order and direct that my Executor hereinafter named, out of my bequest given to him in this my Will, find, provide and allow him, my said son Richard Pook, all and all manners of Apparel of all sorts whatsoever during his apprenticeship.

I also give and bequeath to my said son, Richard Pook one Gold Ring and one Silver Bowl

I also give and bequeath to my daughter Mary Pook, her Executors, Administrators and Assignees, all those two Dwell houses and Garden Plotts lying and being in Culmstock aforesaid now in the tenure or occupation of Jacob Wood and Nicholas Byshop, together with the Indentures or Leases whereby I hold the same, to have and to hold the same and every part and parcel thereof with the appurtenances unto my said daughter Mary Pook, her Executors, Administrators and Assignees from and immediately after my decease, for and during all the rest residue and remainder of the term of years (determinable on lives) which shall be therein then to come and unexpired

I also give and bequeath to my said daughter, Mary Pook all my wearing apparel of all sorts whatsoever. Also I give and bequeath to my said daughter, Mary Pook four gold rings

I also give and bequeath to my five grandchildren, that is to say Thomas Pook, Anthony Pook, Henry Pook, George Pook and Sarah Pook one guinea apiece, which said several legacies or sums of money, I will and order shall be paid to the respective Legatees by my said daughter Mary Pook out of the Rents, Hires and profits of the two dwelling houses which I have hereinbefore given to her when they shall attain at their several and respective ages of one and twenty years

I also give and bequeath to my granddaughter Sarah Pook my largest Brass Pott.

All the rest, residue and remainder of my goods, Chattels, Rights, Credits and Personal Estate whatsoever after my just debts, funeral, expenses and Legarys are paid and discharged, I give and bequeath unto my said son Nicholas Pook 

And I do hereby make, nominate, constitute and appoint my said son, Nicholas Pook Executor of this my last Will and Testament. And I do hereby revoke, annul and make void all and every former and other Will and Wills, Testament and Testaments by me at any time or times heretofore made and published, declaring this only to be my last Will and Testament. In witness whereof, I have hereunto set my Hand and Seal the seventh day of December in the year of our Lord one thousand seven hundred fifty and one. The mark of Elizabeth Pook.

Signed sealed published and declared by the said Elizabeth Pook, the testator, as and for her last Will and Testament in the presence of us who in the said Testator’s presence, and in the presence of each other have subscribed our names as Witnesses hereto after interlineation of the word (Assignees William Perriam, John Flood, Jacob Wood)

This Will was proved at London the fourteenth day of August in the year of Our Lord one thousand seven hundred and fifty four before the Right Honourable Sir George Lee? Knight Doctor of Laws Master Keeper and Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of Nicholas Pook the son of the deceased and Executor named in the said Will to whom Administration was granted of all and singular the Goods Chattels and Credits of the said deceased having been first sworn by Commission only to administer.
