Will of Fleet Arnold, now Masters fifth Mate of the Chesterfield East India Ship of Dartmouth

In the Name of God Amen I ffleet Arnold of Dartmouth in the County of Devon now Master's iiiith Mate of the Chesterfield East India ship being in good Health of Body and of sound Mind memory and understanding do to prevent controversys after my decease make publish and declare this my last Will and Testament in manner following (that is to say) first and principally I resign my Soul to Almighty God that gave it and my Body I commit to the Earth or Sea as it shall please God to order and as to such Worldly Estate it hath pleased God to bless me with I give and dispose thereof as followeth (that is to say) I give and devise unto my sister Sarah Jones (the Wife of John Jones of Dartmouth aforesaid now Master of his Majestys Ship Bellona) All those my two Messuages or dwelling Houses divided into three Tenements and all and singular other the Premises thereunto belonging situate lying and being in Dartmouth aforesaid in the Parish of Saint Saviours in the said County as the same is now in the Occupation of James Stracey Gilber Kinnicott and Peter King to hold the said Messuages or dwelling Houses and all other the Premises thereunto belonging unto my said Sister Sarah Jones her Heirs and Assigns for ever subject nevertheless and chargeable with the Payment of the Sum of five Pounds of lawful Money of Great Britain to be paid to my Honoured Mother Jane Arnold of Dartmouth aforesaid Widow and her Assigns for and during her natural Life out of the Rents Issues and Profits of the said Messuages or Tenements and Premises above mentioned on the four most usual ffeasts or Quarter Days in the Year by even and equal Portions the first payment thereof to begin and be made on such usual ffeast or quarter Day of Payment as shall next happen after my decease clear and free of all charges and deductions whatsoever and I do hereby direct and order that my said Sister Sarah Jones her Heirs or Assigns to pay the said Annuity accordingly but in Case my said Sister Sarah Jones her Heirs or Assigns do and shall neglect or refuse to pay the said Sum of ffive Pounds as aforesaid within seven Days next after or over any or either of the said ffeasts or Quarter Days of payment on which the same ought to be paid as aforesaid that then and from thenceforth and as often as it shall so happen it shall and may be lawful for my said Mother Jane Arnold and her Assigns to enter into and take possession of the said several Messuages Tenements and Premises so abovementioned until the Arrear or Arrears of such Annuity shall be fully paid and satisfied together with all and full Costs and Charges to issuing and concerning the same out of the Rents Issues and Profits thereof which she my said Mother Jane Arnold is hereby Authorised and impowered to take and receive I also give and devise unto my Neice Sarah Jones (the Daughter of the said John Jones and Sarah his Wife) all that my Messuage Tenement or Dwelling House and Premises with the Appurtenances thereto belonging situate lying and being in a Place called Kingsware in the said County of Devonshire as the same is now in the Tenure or Occupation of William Lake a Cooper to hold the said Messuage Tenement or Dwelling House and Premises and all other the Premises unto my said Neice Sarah Jones her Heirs and Assigns for ever Also all and singular that my Plate now in the Hands of Mr William Cowell the Collector of the Customs in Dartmouth aforesaid (that is to say) One Silver Quart Tankard Six large silver spoons one silver salver all marked H.D. and one Gold Ring the same and every part thereof I do give and bequeath unto my Nephew John Jones (son of the said John Jones and Sarah his Wife) also I give and bequeath to my Sister Elizabeth Arnold the sum of Thirty Pounds out of my Personal Estate to be paid her within Twelve Months next after my decease also all the Rest residue and remainder of all and singular my Goods Chattells and Personal Estate whatsoever and wheresoever and of what nature or kind soever which shall be in any ways due owing payable and belonging unto me at the Time of my decease (after the payment of my just Debts and Legacys above mentioned and my ffuneral Charges) I do hereby give and bequeath the same and every part and parcel thereof unto my said Sister Sarah Jones her Executors and Administrators And I do hereby make nominate and appoint my said Sister Sarah Jones full whole and sole Executrix of this my last Will and Testament and I do hereby revoke all former and other Wills by me at any Time heretofore made or declared either by Word or written In Witness whereof I have to this my said last Will and Testament contained in two sheets of paper to the bottom of the first Sheet I have set my Name and to this last Sheet my name and seal this Twenty seventh day of October in the Year of our Lord One Thousand seven Hundred and forty seven and in the Twenty first Year of the Reign of our Sovereign Lord George the Second over Great Britain and so forth Fleet Arnold
