IN THE NAME OF GOD AMEN. I John Penny the Elder of the Parish of East Ogwell in the County of Devon Yeoman being of sound and collected Mind and Understanding praised be God for the same but being weak in body and mindful of the uncertainty of human life and in order to prevent any disputes arising after my Demise as to the disposal of the Property it has pleased the Almighty to bless me with Do make and publish this my last Will and Testament in manner following. First I revoke and make void any former Will or Wills by me at any time heretofore made. Also I give and bequeath unto my dearly beloved wife Mary Penny the Sum of Fifty Guinnes of Lawful Money of Great Britain. Also I give and bequeath unto my Son William Penny the sum of Fifty Pounds of lawful Money of Great Britain. Also after the death of his Mother I give him the said William Penny the bed and furniture that now stands in my parlour chamber. Also I give and bequeath unto Mary Bulley wife of John Bulley my daughter the sum of Twenty five Pounds of lawful Money of Great Britain. Likewise I give and bequeath unto Elizabeth Penny wife of my son Richard Penny the Sum of fifteen Pounds of like lawful Money. Also I give and bequeath unto my two Grandsons John and Richard Penny sons of the Said Richard and Elizabeth Penny the Sum of five Pounds a piece of like lawful Money. All which said several and respective legacies shall be paid to the said several and respective Legatees within three Months after my decease by my Executrix and Executor hereinafter named. And as touching and concerning my son John Penny I do order and my Will is that my Executrix and Executor shall provide and procure for him the said John Penny sufficient Meat Drink Wearing Apparel and every thing necessary for him for the space of Ten Years after my Decease. All the rest residue and remainder of my Goods Chattels personal and testamentary Estate and effects whatsoever and wheresoever and of what nature kind and quality never the same may be and not herein before given and dispensed of after payment of any just Debts Legacies above mentioned Funeral Charges and the expense of proving this my Will I hereby give and bequeath the same unto my beloved wife Mary Penny and my Son Edward Penny share and share alike. And I do Nominate Constitute and appoint them the said Mary Penny my Wife and Edward Penny my Son to be Executrix and Executor alike jointly of this my last Will and Testament.

IN WITNESS whereof I John Penny the Testator have hereunto set my hand and seal this third day of November in the Year of Our Lord One Thousand Eight Hundred and Thirteen.

The Legacies to the above named John and Richard Penny my grandsons are not to be paid them until they arrive at the age of twenty-one and if either of them happen to die before he arrives at that age his legacy shall go to the survivor of them.
