Will of Jonathan Pethybridge, Domestic Servant of Saint David Exeter 1849

This is the last Will and Testament of me Jonathan Pethybridge of the Parish of Saint David in the County of the City of Exeter Domestic Servant I give and bequeath to my Brother Richard Pethybridge of Starcross in the County of Devon my Silver Watch and Gold Watch chain Also my Writing Desk Clothes wearing apparel the whole contents of my wardrobe for his own absolute use and benefit and subject to the payment of all my just debts funeral and testamentary expences I give devise and bequeath the nine twenty pound shares consolidated Stock in the Eastern Counties Railway Company of which I am the Proprietor and my own share in the National Loan Company and all the Rest residue and remainder of my real and personal Estate and Effects whatsoever and wheresoever unto my said Brother Richard Pethybridge his heirs executors administrators and assigns To hold the same respectively upon trust that he the said Richard Pethybridge his heirs executors administrators and assigns do and shall as soon as conveniently may be after my decease as he may in his discretion think fit convert sell and dispose of the same respectively and from and out of the proceeds thereof divide retain and pay the same to himself and my two Sisters hereinafter named in the following proportions namely one third part thereof to my sister Grace Weakley Wife of John Weakely now residing at No 8 Northernhay Row in the City of Exeter to be paid unto her proper hands and to be held received and applied by her independent of the control debts and engagements of her present or any future husband one third part thereof to my Sister Mary Alford the Wife of William Alford of Saint James in the County of the City of Exeter Tailor to be paid unto her proper hands and to be held received and applied by her independent of the control debts and engagements of her present or any future husband and the remaining one third psrt thereof to be retained by my said Brother Richard to and for his own absolute use and benefit and it is my desire in reference to the sale and conversion of my said Real and Personal Estate and the discretion hereinbefore given to my said Brother Richard as to the time of such Sale and conversion that the whole or part thereof may be sold and realized at one or different times as he may deem most advantageous and I direct that the division and application of the proceeds of the whole or part thereof as and when the same shall be sold and realized (my debts funeral and testamentary expences being first paid) shall immediately thereafter be made between my said Sisters and himself in the proportion of one third to each as before directed and I hereby declare that it shall be lawful for the said Richard Pethybridge to sign and give any receipt or receipts in writing for any Sum or Sums of money which shall be from time to time paid or payable to him under the Trusts of this my Will And that the Person or Persons paying the same shall not be bound to see to the application or be accountable for the misapplication of the same And I hereby revoke all Wills by me at any time heretofore made and constitute and appoint the said Richard Pethybridge sole Executor of this my last Will and Testament Lastly I desire it to be understood that although no provision is made by me for my dear mother I am not unmindful of her necessities but have full confidence that she will continue to enjoy the care and protection of my brother and Sisters herein named and that her wants will be supplied by them so long as she lives In Witness whereof I have hereunto set my hand this nineteenth day of June in the year of our Lord one thousand eight hundred and forty nine Jonathan Pethybridge
