Estate Duty Office Will of Robert Farrant late of Tedburrow

IRW Copy Will of Robert Farrant, Late of Tedburrow within the parish of Hemiock Gentleman, Died 17th February 1844,

Proved in the Principal Registry of the Lord Bishop of Exeter 14 August 1844 by two of the four Executors, Edward Farrant and John Farrant of Hemyock in the county of Devon Gentlemen

 

This is the last Will and Testament of me Robert Farrant of Tedburrow within the Parish of Hemyock in the County of Devon Gentleman being of a sound and disposing mind memory and understanding hereby revoking and making void all former Will and Wills by me at any time heretofore made 

First I give and bequeath unto my wife Mary Farrant such part of my goods and furniture as she shall make choice of not exceeding in value fifty pounds

Also I give unto my said wife Mary Farrant my Cottage or Dwelling House with the Garden Orchard and Premises thereto belonging situate in Hemyock aforesaid and now in possession of my sister Edith Farrant and James Wood for and during her natural life she keeping the same in good and tenantable repair 

And from and after her decease I give and devise the same unto my son Samuel Farrant his heirs and assignees for ever 

Also I give unto my said wife Mary Farrant and her assignees for and during so long time as she shall live and remain my widow and unmarried one annuity clear yearly rent or annual sum of sixty pounds to be paid her quarterly by my four sons equally out of the lands hereditaments and premises hereinafter given and devised to them and their heirs and on the following days viz Christmas day, Lady day Midsummer day and Michaelmas day the first of such payments to begin and be made on the first of such days as shall next happen after my death with power of distress on non-payment thereof or any  as is usual in cases of distress for rent. 

Also I give and devise unto my said son Samuel Farrant all that Messuage or Dwellinghouse with the Gardens Courts & Buildings thereto belonging commonly called West Town and all those Closes of Land called the Lower Orchard, Higher Orchard Saltcroft Meadow Westland Reyland West Reyland Shilford Meadow Leypark and the South Hedge thereof, part of my Estate called West Town also Fursclose containing about five acres and half situate at Hackpenhill all in Hemyock aforesaid Also Frysclose plantation and the sideling containing two acres one rood and thirty nine perch And also Sideling plantation and Pits containing about one acre two rood and thirty nine perch also situate in Hemyock aforesaid 

To hold the same unto  and to the use of my said son Samuel Farrant his heirs and assignees for ever subject and charged with the payment of the annual sum of fifteen pounds during my said wife’s widowhood being his fourth part of her said annuity And also to the payment of one fourth part of all annuities legacies and debts charged and made payable and unsatisfied under the Will of my late deceased brother Samuel Farrant 

But if my said son Samuel Farrant shall happen to die without leaving issue living at the time of his decease then I give and devise the said last mentioned Messuage Tenement closes Lands Hereditaments and Premises (subject and charged as aforesaid) unto my three sons Edward Farrant Henry Farrant and John Farrant their heirs and assignees as Tenants in Common and not as joint Tenants 

Also I give and devise unto my said son Edward Farrant all that my Messuage or Dwellinghouse with the Gardens Courts Buildings and Premises thereunto belonging called Newhouse in Potters 

And also those Closes of Land and Premises called Pit Orchard, Long Orchard, Back Orchard, Higher Orchard, Brimley (except the north hedge thereof) Home Close (except the north hedge thereof) Cottles Close, Shearpark, The three Acres, Tedburrow Close, Lands Meadow, Brandys, Brandys Orchard Downlands and the Coppice adjoining, Shearpark all part of Newhouse or Potters farm situate in Hemyock aforesaid 

Also the Croft except the west hedge thereof and the Great Meadow (except the west hedge thereof) both part of West Town estate together with the right of way to and from the same for all purposes in through and over my Closes of Land called the Easternham and Westernham as heretofore used and exercised and for all other needful and necessary purposes 

Also the Seven Acres with the South hedge thereof, Browplot, Browfield Plantation and sidling (late Common) part of Tedburrow Estate in Hemyock aforesaid Also the Nursery Field (other part of West Town) and part of the Nursery or Coppice Orchard As marked and containing about a quarter of an acre (other part of West Town) all which said premises are situate in Hemyock aforesaid. 

To hold the same unto and to the use of my said son Edward Farrant his Heirs and assignees for ever Subject and charged with the payment of the sum of fifteen pounds annually to my said wife during her widowhood being his fourth part of her said annuity And also to  the payment of one fourth part of all annuities legacies and debts charged and made payable under the said Will of my said brother Samuel and unsatisfied.

But if my said son Edward Farrant shall happen to die without leaving issue living at the time of his decease then I give and devise the said Messuages Tenements Lands and Premises unto my said sons Samuel Farrant Henry Farrant and John Farrant their Heirs and Assignees as Tenants in Common and not as joint tenants 

Also I give and devise unto my said son Henry Farrant All that my Dairyhouse with the Garden and Orchard thereto belonging now in possession of William Browning Also all those closes of Lands called Unwoods Orchards, The residue of  the Nursery or coppice Orchards Westernham & Easternham (except the right of Way to Great Meadow) Little Meadow with the east hedge thereof  Shortlands, Little Close, Furse Park, West Green Close, East Green Close and Barton, Bowey with the east hedge thereof, Coppice close, Heather close on Hackpenhill, Middle Close in Hackpenhill and Yonder Close on Hackpenhill all situate in the said parish of Hemyock and other part of West Town Estate

To hold the same unto and to the use of my said son Henry Farrant his Heirs and Assignees forever Subject and charged with the payment of the annual sum of fifteen pounds to my said wife during her widowhood being her fourth part of her said annuity And also with the payment of one fourth part of all annuities legacies and debts chargeable and made payable and now unpaid or satisfied under the said Will of my said brother Samuel 

But if my said son Henry Farrant shall happen to die without leaving issue living at the time of his death then I give and devise the said Dairy House Closes Lands Hereditaments and Premises subject and charged as aforesaid unto my said sons Samuel Farrant Edward Farrant and John Farrant their Heirs and Assignees as Tenants in Common and not as joint Tenants 

Also I give and devise unto my said son John Farrant my Dwellinghouse wherein I now reside called Tedburrow with the Gardens Bartons Buildings and Premises thereto belonging and all those several closes of Land called the Higher Orchard, Lower Orchard, with the cottage and Garden adjoining the Nursery Orchard, Burrow close, long close, the eight acres the Meadow under the house, Deep Sellick, Cripple Croft, Little Tedburrow field, Cunnigar field, the six acres in Hackpenhill (except the north hedge thereof) all part of Tedburrow Estate and situate in Hemyock aforesaid 

And also all those two closes of Land called East Tedburrow field and West Tedburrow field other part of West Town Estate

To hold the same unto and to the use of my said son John Farrant his heirs and assignees for ever Subject and charged to and with the payment of the annual sum of fifteen pounds to my said wife during her widowhood being his fourth part of her said annuity And also to the payment of one fourth part of all annuities legacies and debts charged and made payable and now unsatisfied under the said Will of my said late brother Samuel Farrant 

But if my said son John Farrant shall happen to die without leaving issue living at the time of such his death then I give and devise the same Dwellinghouse Land Hereditaments and premises subject and chargeable as aforesaid unto my said three son Samuel Farrant Edward Farrant and Henry Farrant their heirs and assignees for ever as tenants in common and not as joint tenants 

Also I give unto my said son John Farrant the sum of two hundred pounds sterling 

Also I give to my said son Henry Farrant the sum of fifty pounds sterling. 

Also all the rest residue and remainder of my messuages lands tenements Hereditaments and premises situate in the said parish of Hemyock or elsewhere And all other my personal property I give devise and bequeath the same and every part thereof unto and to the use of my said four sons Samuel Farrant Edward Farrant Henry Farrant  and John Farrant their Heirs executors administrators and assignees for ever equally share and share alike as tenants in common and not as joint tenants Subject and charged nevertheless to and with the payment of my just debts legacies funeral expences and the expence of proving my Will 

And lastly I do hereby nominate constitute and appoint my said sons Samuel Farrant Edward Farrant Henry Farrant and John Farrant joint Executors and residuary devisees of this my Will

 In Witness whereof I the said Robert Farrant have to this my Will comprised in or written on four sheets of paper affixed and sealed together set my hand to the three first sheets thereof and my hand and seal to the fourth and last the eighth day of December one thousand eight hundred and forty three signed sealed published and declared by the said Robert Farrant the Testator as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as Witnesses  thereto
