Estate Duty Office Will of Samuel Farrant of Hemyock, Gentleman (1824)

Inland Revenue Will of Samuel Farrant 1824 late of Hemyock, gentleman – died 25th March 1824 -proved 17th August 1824 by Samuel Farrant of Hemiock in the County of Devon yeoman the residuary Legate and Executor
This is the last Will and Testament of me Samuel Farrant of West Town in the parish of Hemiock and County of Devon, Gentleman, made the tenth day of August in the year of our Lord one thousand eight hundred and twenty one.
I give and devise all that my Messuage and Farm situate at or called Whitmoor in Hemiock aforesaid now in the occupation of my eldest son John Farrant with the Lands and Appurtenances thereunto belonging unto and to the only use and behoof of him my said son John Farrant, his Heirs and Assignees for ever.
Also I give and bequeath to my son Robert Farrant the sum of three hundred pound to be paid to him by my Executor hereinafter named in one year after my decease.
Also I give and bequeath to my said son John Farrant and my son in law William Thomas the sum of one hundred pounds upon Trust to pay the interest thereof during the life of my daughter Sarah Fry to her my said daughter or to such other person or persons as she shall from time to time direct, separate and apart from her husband and not to be subject to his Debts and Controls, and the Receipts from time to time of my said daughter or of such other person or persons to whom she shall direct such Interest to be paid shall alone be a sufficient discharge to my said Trustees for the same.
And Upon Trust immediately after her decease to pay the said principal sum of one hundred pounds unto and equally be divided between her two sons Richard Fry and Robert Fry if both of them shall live to attain the age of twenty one years. And if either of them shall die under age, then the whole to go and be paid to the survivor of them at his age of twenty one years.
And until the aforesaid Trusts shall be performed it is my Will that my said Trustees shall lend the said Trust monies at Interest from time to time as they shall think fit. And that out of such Trust Monies they shall pay and reimburse themselves all necessary expenses.
And I give and bequeath to my daughter Mary Thomas the sum of fifty pounds to be paid to her by my Trustees in six months after my decease.
Also I give and bequeath to my daughter Margaret Farrant the sum of three hundred and ten pounds and to my daughter Edith Farrant the like sum of three hundred and ten pounds to be paid to them respectively by my Executor in six months after my decease with Interest on those two last mentioned legacies from the time of my decease.
Also I give and bequeath all my Plates China and Glass to my daughter Margaret and Edith equally to be divided them and to my daughter Margaret the Chest of Drawers standing in my bedroom.
Also I give devise and bequeath all that my Messuage and Farm situate or called West Town aforesaid now in my own occupation with the Lands, the Allotments on Hackpen Hill and other Appurtenances thereto belonging and all that my new built dwelling house commonly called the Dairy house situate in Hemiock aforesaid by the side of the road heading towards Culmstock with the garden and orchard on the opposite side of the road occupied therewith, and the Appurtenances thereto respectively belonging unto, and to the only use and behoof of my son Samuel Farrant, his Heirs and Assignees for ever.
Also I give and bequeath all my Stock, Household and other Goods money and other Personal and testamentary of any Estate and Effects whatsoever unto my said son Samuel Farrant, his Executors and Administrators and I make and appoint my said son Samuel Farrant, residuary Legator and sole Executor of this my last Will and Testament. Nevertheless I charge the real as well as personable Estate hereby given to my said son Samuel with the payment of any just Debts, Funeral and Testamentary Expenses and the several pecuniary Legacies above mentioned.
And I hereby revoke all former Wills and Testamentary dispositions by me made. In witness whereof I have to this my last Will and Testament written upon and contained in two sheets of paper to the first sheet thereof set my hand and to the last my hand and seal the day and year first above written
Signed Sealed Published and declared by the said Samuel Farrant the Testator as for and to be his last Will and Testament in the presence of us who have subscribed our names as witnesses hereto at his request in his presence and in the presence of each other

Codicil
I the within named Samuel Farrant the Testator do make and declare this to be a Codicil to my written last Will and Testament.
I hereby give and bequeath to my daughter Sarah Fry the sum of one hundred pounds to be paid to her in one year after my decease by my son John Farrant out of my farm situate at or called Whitmoor in Hemiock which I charge with the payment thereof. And I direct that the same shall in no way be chargeable on my Personal Estate. And I declare this Legacy to be in addition to the Benefit she will take under my within written Will.
Also I give and bequeath to my daughter Mary Thomas the sum of forty Pounds in addition to the sum of sixty pounds given to her by my said Will to be paid to her by my Executor at the same time as the said Sixty pounds and charged and chargeable upon the same real as well as personal Estate
And I ratify and confirm my said Will in all respects other than the same is altered by this codicil
In Witness whereof I have hereunto set my hand and seal the twenty sixth day of April in the year of our Lord one thousand and eighteen hundred and twenty two
