The Last Will & Testament of Richard Scott, Late of Highampton
In the Name of God Amen I Richard Scott of the Parish of Highampton in the County of Devon Yeoman being sick and weak but of perfect sound mind and meaning thanks be given to God for it do ordain this my last Will and Testament (as follows).
First I give and bequeath unto Beatrice Scott, my wife for and during her natural life One clear annually yearly Rent Charge or sum of Eleven Pounds per year of lawful money to be issued and payable to her out of all that Messuage Tenament Hereditaments and premises called Hellick still situate in the Parish of Highampton in the said County of Devon on the four most used and feasts or days in the year (Lady Day, Midsummer Day, Michelmas Day and Christmas Day) the first payment to be made and begin the First Quarter Day after my decease and if it so happen that the said annuity Rent Charge or sum of Eleven Pounds or any part thereof shall be left unpaid by the space of Twenty days next after any of the said Feasts or days for payment of the same aforesaid. Her then to have the liberty to distrain for the same to pay all such dues and arrears with all Costs and Charges.
Also I give unto my said wife Beaton Scott the use of the Bed complete which she usually sleeps upon and the set of drawers in the same room during her natural life.
Also I give unto my son Edmond Scott during the joint lives of my said wife the said Beaton Scott and the said Edmond Scott one annually or clear yearly Rent Charge or sum of Seven pounds of lawful British money on the like manner and days aforesaid giving and payable out of the before named premises as to my said wife Beaton Scott with the same powers of distress and recovery of the said anuity (Ricd Scott x his mark) and immediately after the death of my said wife Beaton Scott to be paid unto the said Edmond Scott the full sum of eight pounds of lawful British money (as another annually clear Rent Charge or sum of during his natural life) to be paid as aforesaid and the first payment to begin on the next Quarter day of the death of the said Beaton Scott.
Also I give unto my son Thomas Scott his Executors, Administrators and Assigns the sum of One Shilling of lawful money of Great Britain to be paid him by my Executor hereinafter mentioned within One year after my decease.
Also I give unto my son Joseph Scott his Executors, Administrators and Assigns the sum of Two Pounds of lawful British money to be paid him by my Executor within One year after my decease.
Also I give unto my son Richard Scott his Executors, Administrators and Assigns the full sum of Eight Pounds per year for the time or term of Ten Years the first payment to begin the first Twelve month day after my decease but if the said Richard Scott his Executors, Administrators and Assigns shall ask sue or demand payment of the Principal money and Interest due from me to him or my beneficiary note of hand then I hereby revoke and avoid the payment of the said sum of Eight Pounds per year aforesaid.
Also I give unto my daughter Elizabeth Paige the sum of One shilling of lawful money to be paid her within One year after my decease.
Also I give unto my son George Scott his Executors, Administrators or Assigns the sum of One Shilling to be paid within One year after my decease (Ricd Scott x his mark).
Also I give unto my daughter Sarah Hawkins the sum of Ten Pounds of lawful money to be graced her by my Executor within One year after my decease.
Also I give unto my daughter Jane Ball the sum of One Shilling of lawful money to be paid her by my Executor within One year after my decease.
All the Rest, Residue and Remainder of my Real and Personal Estate and Effects whatsoever or wheresoever.
I give devise and bequeath unto my son Nicholas Scott his Executor, Administrators and Assigns I hereby appoint Nicholas Scott my son whole and sole Executor of this my Last Will and Testament. In Testimonywhereof I have hereunto set my hand and seal this 17th day of June One Thousand Eight Hundred and Seventeen.
Signed, Sealed and Delivered by the Testator Richard Scott his Last Will and Testament containing three sheets of paper the first he has subscribed his name and to the third and last sheet set his hand and seal in the presence of us who in his presence and his request and in the presence of each other have subscribed our names as witnesses to the same.
