Brice's Weekly Journal, Exeter, Friday, July 4, 1729 - Issue 220
The Fee and Inheritance of the Manor of Lapford, consisting of 67 Tenements and Cottages, and about 1540 Acres of Land, lying about 7 Miles from the Town of Crediton, and about the same Distance from the Markets of Okehampton and Chulmleigh, also several Estates adjoining Lapford, lying in the Parish of Morchard Bishop, consisting of 9 Tenements and Cottages, and about 330 Acres; being late the Lands of Richard Lee, Esq; decea'd; is now to be sold. In the Parish of Lapford, Devon Lost, on the 13th of this Month, a young, small, red or Liver-coloured Spaniel Dog, a yellowish Spot over each Eye, rather long in his body, very fond and active, answers to the name of Scamper. Whoever will restore the said Dog to the Rev. Mr Radford, at Lapford Parsonage, shall receive Five Shillings, and all reasonable Expenses paid. No great Reward will be offered. Whoever detains the Dog after this public Notice, will be prosecuted. Lapford, January 26, 1800.

For disposing of the same, a public Survey will be held at the London Inn, in Morchard Bishop, on Friday the second day of May next, by Three o'clock in the Afternoon. To be Sold, either together or in Lots, with Immediate Possession, the Fee-simple and Inheritance of all that Farm, called Irishcombe, in the Parish of Lapford, consisting of a good Farm-house, with convenient Outhouses, and One Hundred and Forty five Acres of Meadow, Arable and Pasture Land. And also a Farm called Blagrave, in the Parish of East Worlington, containing One Hundred and Ten Acres of Orchard, Meadow, Arable and Pasture Land. These Estates are now let to John White for 115l. a Year, capable of great Improvement; and are situate Half a Mile from the Turnpike Road leading from Exeter to Southmolton; four Miles from Chulmleigh, seven from Southmolton, twelve from Crediton and Tiverton, and twenty from Exeter. These premises are distant about 16 miles from Exeter, Tiverton 13, Crediton 8, Southmolton 13, and 5 from Chulmleigh - all good market towns; and about 15 miles from Lyme. Two Capital Farms - to be Let for fourteen years, from Lady-day next. Lot 1 - the Barton of Bury in the parish of Lapford, Devon, in the occupation of Mr John Partridge; consisting of a large and convenient mansion-house, capacious out-houses, and 278 acres of extraordinary good orchard, meadow, arable and pasture land. (Also included in the sale was the Barton of Loosedon, in the parish of Winkleigh.) A survey for this purpose will be holden at the King's Arms, in Chulmleigh on Friday the twenty-third day of June next, by five o'clock in the evening. For further particulars, apply to N. Fire at Lapford On Saturday the 5th of this instant May, a dreadful Fire broke out in the village of Lapford, which entirely destroyed the Buildings and Out-houses of Seven Families, who are thereby reduced to the greatest distress. The poor suffers therefore humbly solicit the charitable assistance of the public; and the smallest donations will be thankfully received at the different Banks in Exeter, and the printers of this paper; or by the Rev. Mr Churchill of Eggesford; Rev. Mr May of Chawleigh; Rev. Mr Radford, Lapford; Wm. Tucker Esq. Down St Mary, who, with other neighbouring gentlemen, will be formed into a committee to secure a prudent application of the benefactions. The loss, at a moderate computation if £1350 and upwards.

Devon - to be Sold in Fee, all those Messuages and Tenements, called Rensy's Dry-House and Lapford Town Tenements, situate and lying in the parish of Lapford, in the county of Devon, consisting of a good farm house, and convenient out-houses, and about 170 acres of very improvable arable, meadow, pasture, orchard and wood land, now in the occupation of Mr James Vicary, as tenant thereof. These Estates are about 8 miles from Crediton and 6 miles from Chulmleigh, and very near the turnpike road, between these good market towns. For which purpose a survey will be held at the King's Arms Inn in Chulmleigh aforesaid, on Friday the 6th day of July next by 4 o'clock in the afternoon. The tenant will shew the premises to any person desiring a view, and further particulars may be had of Mr Chanter, of Chulmleigh; of James Pearse, attorney, Southmolton; or of James Pearse, jun., attorney, registrar's office, Barnstaple.

On Saturday night last, as Mr Collihole, a respectable farmer of Lapford, in this county, was returning home from Crediton market, he was thrown from his horse, and received such severe bodily injury, that although surgical aid was promptly administered, he died on Monday night.

On the evening of the 21st ult. A fire broke out on the premises of Mr Edmund Moon, Kelland Farm, Lapford, which consumed the farm buildings - the dwellings were fortunately preserved. There being reason to suppose it was the work of an incendiary, a reward of £100 has been offered for the detection of the offender. The flames so completely illuminated the horizon, that it was observed in this city, though at a distance of 20 miles.

Suicide - Last week, at Irishcombe, in the Parish of Lapford, Mr James Downey, yeoman, was found in his barn, suspended by a rope from the beam. An inquest was held before James Partridge, Esq., Coroner of Tiverton, and a verdict of felo-de-se returned. The body was interred on Saturday night, about 10 o'clock, in a remote corner of the church-yard at Rose Ash.

A Freehold Farm, in Lapford, Devon - To Be Sold, by Public Auction, at The George Inn, in Southmolton, on Saturday, 5th day of September next, at the hour of Three in the Afternoon precisely, by Mr James Dobbs, Auctioneer (subject to such conditions as will be then and there produced) the Fee-simple and Inheritance in possession of all that very Desirable and Improvable Farm, Plantations and Premises called 'Irishcombe Moor', otherwise 'Higher Irishcombe', situated in the Parish of Lapford, in the County of Devon and now (except as to the Plantations) in the occupation of Mr Christopher Clark, and his Tenant - the Plantations being in the possession of the owner. It may be truly said that the Land is of the best quality, that its situation is most desirable, and that its value is likely to be enhanced by the Taw Vale Railway passing through a part of it, and being well situated for a station. Crediton County Court George Wreford v. John Dicker - The plaintiff is a butcher, living at Morchard Bishop; the defendant is a labourer living at Lapford. This action was brought to recover the sum of 15s. 8d., for goods sold and delivered to the defendant in the year 1846. The Judge considering from the evidence adduced, that the plaintiff was unable to support his claim for the amount, except for 7s. 11d., gave a verdict for that amount, to be paid in a month.

Trewman's Exeter Flying Post - Thursday, January 24, 1850 - Issue 4390
On Friday morning last, the body of a young man, aged 30, named Chalice, a native of Lapford, was found drowned in the Basin of the Exeter Canal. The water, with the exception of the end where the deceased was found, was frozen over very hard, and his walking stick was on the ice close by; his hat had caught by the edge of the ice, and frozen to it immediately above where the body was found. The deceased had in his pockets a sum of money amounting to £1 4s. 6d., and the duplicates of two pawnbroker's tickets for coats pledged. Chalice, some short time since, became possessed of above one hundred pounds, and for some time he had been staying about in the neighbourhood of Crediton, but had been in Exeter for the last week. An inquest was held on the body the following day, when a verdict of 'Found Drowned' was returned.

Lapford, Devon - To be Let, by Tender, for Terms of 5, 7, or 14 years, from Lady-day next, all those desirable Farms called 'Higher Bridge', containing 74 Acres, and 'Lower Bridge' containing 71 Acres; situate in the parish of Lapford, Devon. The above Farms adjoin each other, and are bounded by the Turnpike Road From Exeter to Barnstaple; distant 15 miles from Exeter and 7 from Crediton; and will be let either together or separately, at the option of the owners. The Taker will be required to pay all Rates and Taxes and to do the usual Tenant's repairs, and execute Leases, the drafts of which may be seen at the Office of Mr Fulford. Crediton County Court, July 1st John Arundell Radford v. Stephen Cooke - The plaintiff is the Rector of the parish church of Lapford; the defendant is a yeoman living in the same parish. The action was for £17 0s. 6 ½ d. for half a year's rent of part of the glebe lands of Lapford, from Michaelmas, 1849 to Lady-day, 1850. the defendant not appearing, judgment was given for the full amount, to be paid in a month. Richard Stone v. William May - The plaintiff is a yeoman of Lapford; the defendant is a tailor, living in the same place. The action was brought for £19 3s. 4d. a balance due for money lent and advanced on the 19th October 1849. the defendant not appearing, judgment was given for the full amount, to be paid in a month.

Death - August 18, at Kelland Barton, in the parish of Lapford. Mrs Moon, relict of the late Mr Edmund Moon. She was an affectionate mother, a sincere friend, and kind to all who had the pleasure of knowing her, aged 81.

Crediton County Court Peter Tarr v. William Gregory - The plaintiff is a miller, the defendant a labourer, both residing in the parish of Lapford. The plaintiff claimed the sum of £2 6s. 11d., a balance due for goods sold and delivered. Judgment for the plaintiff, for the £2 6s. 11d.; ordered to be paid by instalments of 1s. per month. John Arundell Radford v. Samuel Cooke - The plaintiff is the Rector of Lapford, the defendant, a yeoman, residing in the same parish. This was a new trial, granted on the 5th day of August last. The plaintiff sought to recover the sum of £17 0s. 6 ½ d. ; (i.e.) £15 15s. for half a year's rent of part of the Glebe Land at Lapford, from Michaelmas 1849, to Lady-day 1850, and £1 5s. 6 ½ d. for rates during that period. The defendant (supported by Mr Turner) stated that he took possession of such Glebe Land from the plaintiff at Lady-day 1827, as yearly tenant, and continued in the occupation under such tenancy nearly up to Michaelmas 1848 - that the plaintiff in the interim having become insolvent and his living sequestrated, retook such land from his assignee and sequestrator, commencing at Michaelmas 1848 - that he (defendant) gave notice at Lady-day 1849 to quit the Michaelmas following , at which period he gave up the possession and therefore was not liable to the plaintiff's claim. The plaintiff (supported by Mr Francis) contended that as the defendant took the land from him at Lady-day 1827 and having been in possession at the time the sequestration was relaxed that he was a Lady-day tenant, and was therefore liable to the rent and taxes up to Lady-day 1850, although he had given notice to quit and had left eh Michaelmas previous. It having been satisfactorily proved to his Honour that the defendant had given up possession of the land agreeably to a notice to quit given by the plaintiff's sequestrator and assignee, and had retook the same of them at Michaelmas 1848 during the sequestration, that a fresh tenancy was created and therefore was not liable to the plaintiff's claim, gave judgment for the defendant. Ordered that the plaintiff pay the costs of the present trial and the defendant the costs of the first trial. Several applications were made for summonses out of the district.

Crediton County Court Thomas Wreford v. John Arundell Radford - The plaintiff is a yeoman of Woolfardisworthy, the defendant, the rector of Lapford. The plaintiff sought to recover the sum of £3 5s. 3d., a balance due for goods sold and delivered in the years 1845 and 1846. Defendant not appearing, judgment for plaintiff for the amount claimed - ordered to be paid in a month. William Glanfield v. John Challice - The plaintiff is a tailor and draper, living in Crediton; the defendant, a tailor residing in Lapford. The plaintiff sought to recover the sum of £4 15s. 6 ½ d., balance due for goods sold and delivered in February last. The defendant not appearing, judgment was given for the plaintiff for £4 5s. 6 ½ d. (the defendant having sent 10s. to the plaintiff a day or two previous to the Court House) Ordered to be paid in 8s. a month.

Crediton County Court Harriet May v. Wm. May - The plaintiff is a widow, the defendant a tailor, both of Lapford. The action was brought to recover £16 1s. 9d. for money lent and advanced, and shop goods sold and delivered. The defendant gave notice of a set off of £6 3s. 9d., but the defendant not appearing and not asking the set off in due time, and also omitting to pay the balance into court, his Honour gave judgment for the full amount, and ordered the same to be paid in a month.

Crediton County Court William Clarke v. John A Radford - The plaintiff is a blacksmith of Lapford, the defendant the rector thereof. The plaintiff sought to recover £9 9s. 8d. for work and labour, and materials provided. Mr Francis, of Crediton, appeared for the defendant, and acknowledged the debt, but pleaded for time to pay the same, stating that the defendant was unable to discharge it at once, or to pay a large instalment. Judgment for the amount claimed; order made for payment of £5 on the next tithe day at Lapford (the 15th of February next) the remainder by instalments of £1 per month after that.

Crediton County Court John Edworthy v. William Heywood - This was a claim of £1 2s. for wages. The parties are labourers, residing at Lapford. Defendant protested that he only owed the plaintiff 19s.; and handed in a bill of 12s. 3d. for board and lodgings, and sundry articles, supplied to the defendant, which was to come out of the 19s. His Honour gave judgment for 6s. 9d., the difference between the 19s. and the set off. Jas. Rowcliffe v. John Moon, of Lapford. Mr Francis, Solicitor, appeared for the defendant. The plaintiff claimed £4 13s. 6d. for reaping wheat, in August last. He stated that he and four other men had agreed to cut thirty-five acres of wheat for 5s. 6d. per acre; that they reaped seventeen acres, when Mr Moon put in his own men to reap one of the fields they had agreed for, and they would not finish their contract without an advance of wages. Defendant replied that plaintiff had agreed to bring eight men, instead of four, thereby delaying his work; that he had been compelled to put his own men about it, which had greatly inconvenienced him, and that upon this, the plaintiff and his men had refused to go on without he advanced more money than he had agreed to give them. His Honour said the plaintiff was not entitled to a farthing; and if Mr Moon were to bring an action against him, he would undoubtedly be entitled to a verdict for breach of contract.

Devon Midsummer Sessions Thomas Luxton was charged with stealing on the 27th of May, a peck of a mixture of oats, beans and chaff, the property of William Hudson of Lapford. Mr Ring prosecuted, and Mr Carter defended. Mr Hudson is a sub-contractor for the North Devon Railway, and has stables at Lapford. On the 27th of May, Thomas Harwood, one of his drivers, saw prisoner taking some of the oats, &c. from a manger. There were witnesses called to give evidence to prisoner's character, among whom was the parish constable. Convicted. Sentence, six weeks' imprisonment, with hard labour. William Selly was charged with stealing at Lapford, on the 20th of June, a coat, two silk handkerchiefs, a pair of drawers, two pictures, two canvas bags, a small box, a hair brush and various papers, the property of Thomas Leach. Mr Ring prosecuted. Mr Leach keeps an inn at Lapford, and the articles were kept in an up-stair room. On the 20th, the prisoner was drinking in the bar, and when about to leave he was searched, and they were found on him. Convicted, and ordered to be imprisoned with hard labour for six weeks.

Crediton County Court Richards v. Radford - In this case the plaintiff who resides at Lapford, sued the defendant for recovery of £5 8s. 9d., of which 14s. was for the wages of a daughter, and the remainder for work done by himself. The defendant admitted the greater portion of the claim, but said that she owed nothing to the daughter, who had been ill while in her service for nine weeks. She also put in a set-off for some pieces of timer, and two elm trees 'taken without her (defendant's) knowledge'. His Honour asked the plaintiff whether this was correct? Plaintiff: 'Never had a tree of you in my life, ma'am! Never had a tree of you in my life, ma'am! Never had a tree of you in my life, ma'am!' - (Laughter) His Honour: 'Have you nothing to say but that? You have told me that three times already.' Plaintiff: 'Never had a tree of you in my life, ma'am!. His Honour (sharply): 'Take this gentleman out of Court till he knows how to behave better.' Plaintiff: 'Never had a tree of you in my life ma'am!' - (Laughter). His Honour: 'Sit down, sir, till I have heard the other cases, and you know how to conduct yourself'. The plaintiff accordingly took his seat and the case was not proceeded with till the other business had been disposed of. His Honour gave judgment for £4 3s. 4d.

Accident on the North Devon Railway - On Thursday afternoon the coroner, H. W. Hooper, Esq., held an inquest at the Valiant Soldier Inn, on the body of Richard Dockett, a labourer living at Lapford. The deceased was employed by the contractors for the North Devon Railway, and on the 9th May, was filling some trucks in a cutting. While standing near one of the trucks a quantity of soil fell on him driving him with his back against one of the wheels. There were 12 other men at work near him, who narrowly escaped. He was conveyed to the Hospital, where he died on Wednesday morning. A post mortem examination was made by Mr Edye, who found that the lower part of the back was broken. Verdict 'Accidental Death'. Crediton County Court Coles v. Radford - The defendant, a clergyman of Lapford, was sued by the plaintiff, a cooper, to recover £3 4s. 8d. for work done, and materials. The defendant did not answer, and judgment was given for the amount. His Honour enquired what time should be allowed for payment; when the defendant coolly said he did not think it would be of any use to expect anything till next tithe day.

Trewman's Exeter Flying Post - Thursday, January 25, 1854 - Issue 4632
Petty Sessions, Chulmleigh - On Friday, the Rev. John Radford, incumbent of Lapford, was charged with assaulting a constable in the execution of his duty. A few weeks ago the bailiff of the Crediton County Court went to Lapford to serve Mr Radford with a summons for a debt. He took a constable with him; and it was said that, without any provocation, Mr Radford set upon the constable, struck him four times and violently ejected him from the premises. On the other hand, the defendant alleged that, after summonses had been served, the constable made his appearance with something like defiance in his manner, and the defendant, considering that he had no further business there, ordered him off, but on his refusing to go, forcibly ejected him. The magistrates convicted the defendant in the penalty of £4. 5s., including expenses. Mr Radford said he should not pay a farthing; and in default was committed for a month to the county gaol.

Fatal Accident An inquest was held at the Valiant Soldier Inn, on Saturday last, before H. W. Hooper, Esq., coroner, on the body of Thomas Borne, a lad eleven years of age. Deceased worked for Mr May, farmer of Lapford, and on Sunday, the 24th of May, he was sent to ride a horse to the field. When about half-way, the horse stated off at a trot and threw the boy off, and dragged him for some distance along the road. He was taken to the Devon and Exeter Hospital, where he died on Friday last. The jury returned a verdict of 'Accidental Death'.

Chulmleigh Petty Sessions Harmless Swagger - John Challice of Lapford was summoned for being drunk and riotous on the 29th of April. Policeman Moore seems to have cautioned the defendant's little girl against taking sticks from certain farms: on the day named Challice met Moore and thinking it opportune gave him a bit of his mind concerning his child's honesty and the policeman's meddling. According to the complainant's notion of propriety of speech Challice exceeded the legitimate bounds and Moore summoned him for being 'drunk and riotous'. The defendant denied being tipsy; and in explanation of what transpired he indulged himself in a little self-landation - he had lived for twenty-nine years at Lapford, and during that time 'no one could ever say black's the white of my eye'. The complainant admitted that he had seen the defendant much more tipsy, and he should not have summoned him for drunkenness had he not been abusive to him. The magistrates dismissed the case, and the defendant left the court as perpendicular as a church steeple.

Defendant paid £1 14s. 3d. into Court, and denied the other portion of the claim - alleging that he never had the flour charged for in one particular month. The plaintiff failed to prove the delivery of the flour disputed and his Honour gave judgment for the defendant, without costs.

Crediton - John Radford, of Lapford, had an audience with the magistrates on Thursday for a too free indulgence at Morchard Bishop on the preceding day. Radford and a friend were at the Fountain Inn, where they misconducted themselves to such an extent as to call for the interference of Policeman Milford. Radford wouldn't quietly leave the house, and in helping him out the officer was struck by the Lapford hero. The magistrates fined him £1, with 15s. 6d. expenses.

The action was for £9 12s., damage sustained by plaintiff by the trespass of defendant's cattle and fowls, and was )together with all other matters in difference between the parties) referred to Mr Philip Francis at the November court, and that gentleman now delivered his amended award, whereby it appeared that there was due to the plaintiff the sum of £2 15s; and on the other matters referred to the arbitrator there was due from the plaintiff to the defendant £26. 13s. 6d. The cost of the reference (amounting to £33 14s. 3d) the arbitrator directed to be paid by the plaintiff. Mr Loosemore, on the part of the plaintiff, objected to the award on several grounds; and his Honour ordered the case to stand over to the next court, Mr Loosemore to give defendant notice setting out his objections to the award.

Crediton County Court William Isaac v. Christopher Cheriton - Plaintiff, a miller of Lapford, claimed of defendant, a farmer of Nymett Rowland, the sum of 14s. 11d. for goods. Defendant denied the debt 'in toto' and stated that he never had any transactions with plaintiff; that he always paid ready money; and that 'twas all done out of revenge; twas not for want of money he disputed it, but on principle'. His Honour, after hearing plaintiff's evidence and examining his books, which he remarked were very well kept, observed that it appeared to him defendant defended the action on the 'meritorious principle' of denying a debt that he owed. Judgment for plaintiff for amount claimed.

Crediton County Court George Foster v. Richard Milman - This was a case sent from the Queen's Bench for trial in this court. The original claim was for £21 6s. 9d., for manure and interest; but such amount was reduced to 30s. by payment into court, an admitted set off, and £5 paid to plaintiff, who is a merchant, of Exmouth; and Mr Loosemore for defendant, a farmer of Lapford. A jury had been summoned in the case. It appeared that in July last defendant sent to a Mr Baker, plaintiff's agent, for six bags of Adam's superphosphate. Baker sent dissolved bones instead. Defendant sent it back; but, Baker, refusing to take it in, it was deposited in the road outside Baker's store. Defendant and his witnesses swore positively that the six bags were sent back; whilst Baker and the plaintiff's witnesses were as positive that only four were sent back. Consequently the action was brought to recover the value of the two bags of dissolved bones - 30s. The evidence was very conflicting, and after hearing both sides his Honour summed up, carefully going through the evidence on both sides; and after retiring for more than an hour the jury announced that they could not agree, and that there was no chance of their so doing. His Honour said in that case he had no alternative but to discharge them.

Crediton County Court Thomas Brooke v. Richard Millman - This was a jury case. The litigants reside in adjoining farms at Lapford and there appears to have been constant disputes between them as to the fences. The present action was one of replevin for illegally impounding thirty-nine of plaintiff's sheep. Mr Fryer appeared for plaintiff; Mr Loosemore for defendant. The case had proceeded some way when it was considered impossible for the jury to decide it without a map or plan shewing the hedges, which neither party had with them. An attempt was then made to refer it to a practical surveyor, but without success. His Honour remarked that if his health had been sufficiently well he would have volunteered his services to go to the place and try to settle the matter between the parties. He remarked it was lucky for legal gentlemen there were such parties as the litigants. Ultimately it was arranged that the jury accompanied by a surveyor on each side should go and view the spot and the case be tried next Court.

Trewman's Exeter Flying Post - Wednesday, January 11, 1871 - Issue 5456
Crediton County Court Thomas Leach v. William Dunn - Plaintiff, who was represented by Mr Loosemore, is a farmer of Lapford. Defendant, for whom Mr Fryer appeared, is sub-contractor for repairing the roads. The action was for £10, damage done to plaintiff's mare, 'Maid of Honour', in consequence of defendant's leaving a heap of stones on the public highway. It appeared that on the 5th of September last plaintiff's mare won the second prize at Barnstaple races. On the evening of the 6th defendant's son was riding it home, when between Eggesford Station and the Changestone turnpike gate, the mare shied at a bullock and fell on or against a heap of stones, breaking both knees and sustaining other injuries. It was about nine o'clock in the evening when the accident occurred; it was raining and cloudy. Plaintiff had offered to leave the question to reference, but defendant refused, and when spoken to about the accident appeared to think more of the stones being knocked about than the damage done to the mare, which was blind in the near eye; that was the side the bullock passed. The horse was worth thirty guineas before the accident; plaintiff did not think it was worth £5 now. For the defence it was urged that plaintiff's mare could never have fallen on the stones, as they were not disturbed; that the mare did not pass through the turnpike on the evening in question, which she must have done if she went home by the road where the accident was said to have occurred; that the stones were in a piece of waste by the side of the road - there were fourteen feet of 'metal road' between the waste - that the place in question was always used for lodging stone, although there was a proper depot lying back from the road, about nine or ten perches further on; and the plan of the road was produced, by which it appeared that one corner of the heap of stones was only a few inches from the 'metal road'. His Honour reserved his judgment until he had looked into the Turnpikes Acts.

Lapford This village was the scene of unusual interest on Wednesday last, being the day appointed for the Harvest Festival. A flat was seen waving from the old church tower to mark the joyous occasion, and another at the school. All, both rich and poor, were alike invited to take part in the rejoicing. Through the liberality of Mr Hosegood, the churchwarden, chiefly assisted by the Rector and some few others who had learned 'the luxury of doing good', an entertainment was provided for all the congregation who are accustomed to worship in the parish church. Yes, for all, indiscriminately. Even the Sunday School children were not forgotten. About half past four in the afternoon the whole party assembled in the schoolroom, when the men sat down to enjoy the good old English fare of roast beef and ale, while the women and children were regaled with tea and cake. Several clergymen from neighbouring parishes were present.

Crediton County Court Richard Milman v. Hill and Bolt (Jury Case) - Plaintiff, a farmer of Lapford, for whom Mr Loosemore appeared, sued defendants, auctioneers of Bow, Northtawton, who were represented by Mr Fulford, for £13 6s., amount overcharged on levying two warrants of distress. The facts of the case were that in the beginning of January plaintiff, being in arrear with his rent, his landlord put in a distress for £52 5s. Defendants were employed to execute the warrant - the time for keeping possession under such warrant was extended at plaintiff's request till the beginning of March, and by that time, a second warrant on plaintiff's goods had been put in to defendant's hands to execute by Mr James Searle, for £54 owing to him from plaintiff, and secured by an attornment deed. No settlement had been come to at the expiration of such extended time and defendants prepared to sell when plaintiff told them they were out of possession and had no right to sell and threatened them with an action if they did so. Defendants thereupon drove off to the landlord's and obtained a fresh warrant and on their return found some of plaintiff's things were being removed. The sale took place and realised £156 11s. 8d., the cost of the two warrants, possession and sale amounted to £17. Plaintiff contended that defendants had no right to charge for two warrants and two levies, nor had they any right to do as they had done, charge both him and the buyers at the sale with commission, they having received on the bulk of the sale for appraisement and commission 12 ½ per cent. Defendants' explanation of this was that they had only charged eight days' possession, whereas they held possession for sixty-five days, and they charged plaintiff with the extra commission in lieu of such possession fee. Mr Daw, auctioneer, stated that his practice in distress sales was to charge 7 ½ per cent for appraisement and sale, he never charged commission to both parties. His Honour, in addressing the jury, remarked they would have to decide upon the facts which had come before them whether defendants had overcharged plaintiff. Plaintiff had had ever leniency shown him by defendants, but had not acted towards them in the same spirit. The jury, after retiring a short time, returned a verdict for plaintiff, for £6 14s. 6d. His Honour declined to allow plaintiff any costs or court fees.

District News - Lapford Alleged Concealment of Birth. The Magistrates at Chulmleigh on Wednesday last committed Mary Sanders, a domestic servant in the employ of W. Croot, Esq., Lapford, to the next assizes for concealing the birth of her male child. Dr Trail gave evidence to the effect that the child had been born alive, and that it had died from suffocation.

Lapford - Embezzlement Richard Cross, on bail, was indicted on three charges of embezzling money, the property of Thomas Leech, of Lapford. Mr Clarke prosecuted; Mr Templeton defended. Prisoner was engaged by the prosecutor, a farmer, to lead an entire horse. He neglected to account for five separate sums, and on this being discovered he was apprehended. The defence was that the non-accounting for the money was the result of a mistake, prisoner being unable either to read or to write. Prisoner was acquitted on the two first charges, and no evidence was offered as to the third.

Trewman's Exeter Flying Post - Wednesday, October 22, 1879 - Issue 5984
Lapford - Fowl Stealing George Tancock (on bail) was indicted for stealing two live fowls, the property of Mr Thomas Brook, at Lapford. Mr Kekewich appeared for the prosecution and Mr Clark defended. Mr Books lives at Higher farm, near Lapford. On the night of the 16th July the prosecutor had twenty-one fowls, but on the following morning two were missing, which had particular marks about them. The police went to the prisoner's house and there found the two fowls, which were identified by the prosecutor. Mr Clark contended that the identity of the fowls had not been clearly established and that the witnesses for the prosecution were mistaken, the prisoner having reared the birds himself. The jury found the prisoner guilty and he was sentenced to four months' imprisonment with hard labour.

Serious Fire at Lapford The dwelling-house of the Rectory Farm, Lapford, which was in the occupation of Mr Holwell, has been completely destroyed by fire. On Friday morning, about eight o'clock, signs of fire were discovered rising from the roof. The work people being absent on the farm, assistance was summoned from the village. It was soon seen that the house was doomed, and efforts were at once directed to removing the household goods, cattle and other effects to a place of safety. With the exception of a quantity of wearing apparel and some bedroom furniture, this was successfully accomplished. The farmhouse was connected with the Rectory and for some time it was feared the Rector's house must be ignited. Fortunately, however, the wind (which was high)veered a few points and the conflagration was confined to where it originated. At first the only help at hand was that of a few women, but the Rector, the Rev. C. W. Wilson, and one or two others and Mrs Wilson did good fireman's service in helping to supply the few men with water from the well. It is understood that the loss is covered by insurance in the Equitable Insurance Office.

Devon Centenarian Mildred Jerret, who was baptised at Lapford Parish Church in February 1800, was buried at Lapford on Thursday. She was probably 103 or 104 years of age, as she always declared that she recollected walking to the church to be baptised. She lived in Lapford all her life and married and brought up a family there. Up to within the past few months she was able to look after and care for herself, having full use of all her faculties.
