In the Goods of Samuel Challice deceased
Appeared Personally Samuel Challice of the parish of Lapford in the County of Devon Yeoman
the sole EXECUTOR named in the last Will and Testament of Samuel Challice late of the parish of Lapford aforesaid Butcher
deceased, and made oath that the said deceased died on the twentieth day of May 1846; that he hath made diligent search and due enquiry after, and in respect of the Personal Estate and Effects of the said Deceased, in order to ascertain the full Amount and Value thereof; and that to the best of his knowledge, information, and belief, the whole of the Goods, Chattels, and Credits of which the said Deceased died possessed within the DIOCESE OF EXETER , exclusive of what the Deceased may have been possessed of or entitled to as a Trustee for any other Person or Persons, and not beneficially, (A) but including the LEASEHOLD ESTATE OR ESTATES for Years of the Deceased, as well absolute as determinable on Lives, and without deducting any thing on account of the Debts due and owing from the Deceased, are under the Value of one hundred Pounds, to the best of this Deponents knowledge, information, and belief.
(B) AND this Deponent lastly made Oath, that the said Deceased was not possessed of or entitled to any LEASEHOLD ESTATE or ESTATES for Years either absolute or determinable on a Life or Lives, to the best of this Deponents knowledge, information, and belief.

In the name of God Amen I Samuel Challice of Lapford in the County of Devon being of sound & disposing mind memory & understanding praise to God do make and ordain this present Writing to be and contain my last Will & Testament in manner and form following that is to say First I commend my soul into the hands of Almighty God my Creator hoping & believing a remission of my sins thro' the merits and mediation of my blessed Saviour and Redeemer Jesus Christ My worldly estate wherewith it hath pleased God to bless me I do give and bequeath as follows, that is to say Whereas my Uncle Samuel Challice lately deceased in & by his last Will and Testament duly executed and attested did give and devise unto my Aunt Thomazin Kelland for and during her life all those Fields and Closes of Land & Premises which he had some time before purchased of Thomas Morris and from & immediately after her decease my said Uncle gave and devised the same Closes of Land & Premises to me To Hold the same to me and my Heirs for ever Now I do hereby give & devise the same Closes of Land and Premises & every part thereof to my Son Samuel Challice & to his Heirs for ever from and immediately after the decease of the said Thomazin Kelland but subject & charged nevertheless to & with payment of the Annuity to my Wife & Legacies to my Children as hereinafter mentioned, that is to say First I give & devise unto my dear Wife Mary Challice one clear yearly annuity of Ten Pounds to be issuing and payable to her or her assigns out of my said Closes of Land and Premises during her natural life by quarterly payments the first payments thereof to begin and be made within three months next after my said Son Samuel Challice shall be possessed thereof to be free & clear from all Rates Taxes and Outgoings whatsoever with power to my said Wife or her Assigns to enter & distrain on said Premises in case of the non payment thereof in the same manner as is done for the recovery of Rent in Arrears Also I hereby give unto my Son William Challice the sum of One hundred & fifty pounds to be paid to him out of my said Closes of Land & Premises at his age of Twenty one Years or at the end of Twelve Months next after the decease of the Thomazin Kelland which shall last happen Also to my daughter Eliza Webber I give the sum of Sixty Pounds to be paid to her out of the said Closes of Land and Premises when and as soon as my said son Samuel shall be Twenty two years of age or within Twelve Months after my said son Samuel shall be possessed thereof which shall last happen Also I give unto my Daughter Charlotte Challice the sum of Sixty Pounds to be paid to her out of the said Closes of Land and Premises as soon as she shall be Twenty two years of age if my said Son Samuel shall then be possessed thereof or within twelve months next after my decease which shall last happen Also I give unto my Daughter Mary Richards the sum of Sixty Pounds to be paid to her out of the said Closes of Land ad Premises as soon as my said Son Samuel shall be Twenty two years of age if he then be possessed thereof or within twelve months after my decease which may last happen Also I give unto my Daughter Thirza Challice the sum of Sixty Pounds to be paid to her out of my said Closes of Land and Premises as soon as she shall be Twenty two years of age if my said Son Samuel shall then be possessed thereof or within Twelve Months next after my decease which may last happen All the rest residue and remainder of my Goods Chattels and Effects whatsoever or of what nature or kind soever after payment of my just debts Funeral Expenses and proving this my Will I hereby give & beneath the same unto my said Son Samuel Challice to his use absolutely And I hereby nominate & appoint my said Son Samuel Challice to be whole & sole Executor of this my last Will and Testament In Witness whereof I have hereunto set my Hand & Seal the Twenty eighth day of February in the year of our Lord one thousand eight hundred and forty three
