In the name of God Amen I Edmond Reynell of Malston in the County of Devon Esqr considering the uncertainty of this life & ye necessity for p[re]paring the same do make & appoint this my last will & testamt in man[n]er & form foll[owing] principally I com[m]end my Soul into the hands of Almighty God hoping through the merritts & mediacon [mediation] of my blessed Saviour to [receive] remission of Sins & to inheritt everlasting life & my body I com[mitt to the] earth to be decently interr'd by my Exec[utors] & as concerning my Worldly goods & effects I dispose thereof in man[n]er foll[owing] Impr[im]is I give devise & bequeath unto my Son ffrancis Reynell All those my three fields or Closes of land com[m]only called or known by ye name of Court Gardens wth all & every th'appurt[enances] thereunto belonging lying & being in the parish of Stokinham in the County of Devon To hold unto the said ffrancis Reynell his Exec[uotors] adm[inistrators] & assign[es] for & during all the estate term & terms right & Interest which I have therein Item I give devise & bequeath unto my said Son ffrancis Reynell his Exec[utors] adm[inistrators] & assigns All that my Messuage or Barton com[m]only called or known by the name of Northpoole with their appurt[enances] lying & being in the parish of Southpoole in the County of Devon for & during all the estate term & terms right & interest which I have therein Item I give devise & bequeath unto my Son Edmond Reynell his Ex[ecutors] adm[inistators] & assigns all that my Messuage or Barton lying in the parish of Thurlstone in ye sd [said] County of Devon now in ye poss[ess]ion of Robert Stephens Gent[leman] com[m]only called or known by the name of the Barton or ffarm of Thurlstone for & during all the estate term & terms right & Interest which I have therein Item I give & bequeath unto my Brother George Reynell & George Strode of Dittisham the sume of five hundred pound[es] to & for the use & benefitt of my Daughter Anne Reynell in such man[n]er as is hereinafter menconed The sume to be paid unto them or the Survivour of them within six month[es] next after my decease But my will & meaning is that the sd five hundred pounds shall not by them be paid unto her but yt ye [that the] sums be put out at Interest & the interest thereof paid unto her for her maintenance & that if she happen to marry her Husband shall not have the sd five hundred pounds but only the Interest thereof during the joint lives of him & my sd Daughter & that the principall after my said…Daughters death to be paid unto such Child or Children as she shall then have liveing in equall proporcons [proportions] or in default of such Children then to be paid unto her Exec[utors] or assigns and whereas I have power reserved by my marryage settlement to charge all that my two part[es] of three or my two third part[es] of my Great & small tythes of Broad Clist in the County of Devon with the paymt of any sume or sumes of money not exceeeding two thousand pound[es] Now I hereby expressly charge the sd tythes with the paymt of the sume of five hundred pound[es] & my will is that the sume shall be paid & raised out of the same tythes & be paid to the Hon[oura]ble Sr Wm Courtenay of Powderham Castle Barr[one]t & George Strode beforenamed within one Year next after my decease In trust to & for the separate use of my Daughter Lucy Wife of Jonathan fford Gent so as her said Husband shall not intermeddle or have any thing to do with the same & after the death of my said Daughter Lucy my will & meaning is that the sd five hundred pound[es] shall come remaine & be to such Child or Children of my sd Daughter Lucy as shall be then liveing And whereas I have also power to charge my Mannors of Malston [in Sherford] Netherton [? in Haccombe] Kingston [in Kingston] & Frogmore [in Charleton] with any sume of money not exceeding two thousand pound[es] I do hereby give & devise the same unto my said Son in law Jonathan fford for the term of five hundred Year[es] to the intent that out of the rent[es] Issues & profitt[es] thereof or by leasing the same he may levy & raise the sume of five hundred pound[es] Upon this Condicon only & no other that before he enter upon or take poss[ess]ion of the same he pay or secure the like sume of five hundred pound[es] to Trustees for the use of his sd wife my Daughter Lucy & her Child or Children by him begotten or to be begotten provided always that if my heir shall think fitt & proper to pay the said Jonathan fford the said five hundred pound[es] That then from the time of paymt thereof the sd term of five hundred Year[es] shall cease & det[er]mine Item I do hereby further charge all my said two part[es] of three or my two third[es] part[es] of Great & Small tyth[es] aforesaid with the payment of the further [?] sume of one thousand pound[es] the same to be paid within one Year next after my decease unto my sd two Sons ffrancis Reynell & Edmond Reynell to be equally divided between them & if either of them die before the end of the sd one Year Then the part or proporcon of him so dying to remain to the Survivour of them Item I give unto my dear wife five Guineas & to my Son William ten Guineas to be paid unto them respectively three month[es] after my decease Item all the rest of my good[es] & chattles not hereinbefore given & bequeathed I hereby give & bequeath unto my said Son[es] ffrancis Reynell and Edmond Reynell whom I do hereby make constitute & appoint to be whole & sole Executors of this my last will & Testamt & to pay all my debt[es] & legacyes hereinbefore menconed & I do hereby revoke all former wills [by me] Made In witnes whereof I have hereunto set my [Hand & Seal this] 23d day of June Anno D[omi]ni 1726 Edm: [Reynell]
