Will of Margaret Houle, widow, of Swimbridge (1830)

This is the last Will and Testament of me Margaret Houle of Swymbridge in the County of Devon Widow I give and bequeath unto my son Thomas Houle the sum of fifty pounds of lawful money of Great Britain Also I give and bequeath unto my son William Houle the like sum of fifty pounds of lawful money of Great Britain as aforesaid Also I give and bequeath unto my daughter Mary the wife of John Breayly the sum of fifty pounds of lawful money as aforesaid for her sole and separate use benefit and disposal independently of her husband and the receipt of the said Mary Breayley shall be an effectual discharge for the same legacy of fifty pounds Also I give and bequeath unto my said son Thomas Houlse and my son John Houle the sum of eighty pounds of lawful money as aforesaid Upon trust for my Grand children George Houle Ann Houle Mary Houle and Thomas Houle children of George Houle late of Bishopstawton in the said County Yeoman deceased to be equally divided between them share and share alike and to be vested interests in them respectively as and when they shall attain their respective ages of twenty one years or die under that age leaving lawful issue with benefit of survivorship between them as to their original and accruing shares in case any or either of them die without attaining a vested interest or interests in their his or her share or respective shares And I do hereby direct that the said several pecuniary legacies to be payable and paid at the end of twelve months next after my decease And I hereby declare that it shall and may be lawful to and for my said Trustees and the survivor of them and the executors administrators and assigns of such survivor from time to time to lay out and invest the said sum of eighty pounds in any of the stocks or funds of Great Britain or upon real and other good securities in England at interest to be from time to time altered and transposed as they or he shall think fit and that the stocks funds and securities shall from time to time be subject to the same trusts as the money so to be laid out and invested as aforesaid And I hereby authorize and direct my said Trustees and the survivor of them or the executors administrators and assigns of such survivor notwithstanding the trusts aforesaid during the respective minorities of my said Grand children to apply the interest dividends and proceeds of their respective shares of the said trust money as well as any part of the principal for and towards their support maintenance and advancement as to them my said Trustees and the survivor of them or the executors administrators and assigns of such survivor shall deem meet and most conducive to their advantage which interest dividends proceeds and principal which shall be so applied as aforesaid shall be allowed to the Trustee or Trustees of this my Will notwithstanding the death or deaths of any of my said Grand children before he she or they shall have attained a vested interest or vested interests as aforesaid And I further direct that neither of my said Trustees for the time being shall be answerable for the other or others of them nor for any involuntary losses and that they may reimburse themselves and each other all the expences attending the execution of the said trusts All the rest residue and remainder of my goods chattels personal and testamentary estate and effects whatsoever and wheresoever not hereinbefore given and disposed of (subject to the payment of my just debts legacies before mentioned funeral expences and the charges of proving this my Will) I give and bequeath unto my said son John Houle And I do hereby nominate constitute and appoint his the said John Houle sole Executor of this my last Will and Testament and I hereby revoke all former Wills by me heretofore made and do declare this to be my last Will and Testament In Witness whereof I the said Margaret Houle have hereunto subscribed and set my hand and seal this twentieth day of June in the year of our Lord one thousand eight hundred and twenty eight _ The Mark of X Margaret Houle (seal)
