Estate Duty Office Will of Prudence Farrant of Thorverton, Widow (1834)

Died 23 April 1834 - Will proved in the Archdeaconry Court of Exeter 15 May 1835 by Henry Gervis, Gentleman of Thorverton, son and sole Executor

This is the Last Will and Testament of me Prudence Farrant of Thorverton in the county of Devon Widow being of a sound and disposing mind memory and understanding hereby revoking and making void all former Will and Wills by me at any time heretofore made. 

I desire to be buried at the chapel at Culmdavy in the parish of Hemyock without any funeral pomp or unnecessary expense. 

First I give unto my son John Templeman Gervis the sum of two hundred pounds. Also I give unto my two daurs Jane Richards and Mary Richards the sum of three hundred pounds each which said several legacies I devise to be paid by my Exor hereinafter named within twelve calendar months next after my decease with Interest for the same at the rate of Four pounds per centum per annum commencing from the month after my decease to the period of payment. 

I also give to my daurs Jane Richards and Mary Richards all my plate except my silver tea pot which I give to my said son John Templeman Gervis and whereas sufficient provision is already made for my daughter Ann Farrant under my marriage settlement I do therefore give unto my said daur Ann all or any part of household Goods and furniture which I may be possessed at the time of my decease which she might think proper to make choice provided she is then living with me but not otherwise.

And I do hereby give and bequeath all my Goods Chattles Monies Securities for money Rights Credits Personal Estate and Effects whatsoever and wheresoever except the said Goods and plate hereinbefore given and subject to the payment of my aforesaid legacies Debts and funeral Expenses unto my son Henry Gervis his Exors Adminrs and Assignees. 

And lastly I do appoint my said son Henry Gervis sole Exor of this my Will. 

In witness whereof I have to this my last Will set my hand and seal this fourteenth day of December One Thousand eight hundred and thirty one

Codicil

Whereas I Prudence Farrant of Thorverton in the county of Devon Widow have made and duly executed my last Will and Testament in Writing bearing date the fourteenth day of December one thousand eight hundred and thirty one, now I hereby declare this to be a codicil to my said Will and direct the same to be annexed thereto and taken as part thereof 

And I do hereby declare and direct that the said legacies given to my son John Templeman Gervis and to my daughters Mary Richards and Jane Richards shall be accepted by them in full satisfaction and discharge of all such part and share as he she or they or either of them can or may or could or might claim of into or out of all or any part of the personal estate and effects of my late daughter Prudence Gervis dec. and in the event of their or either claiming any such part or share of my said daughters personal estate I do hereby revoke the said legacies by my said Will given and I do give to each of them claiming such part or any part of the said personal estate of my said decd daughter  the sum of one hundred pounds only it being my Will and intent that my said decd daughters property shall form and be considered a part of my estate and Effects. 

In witness whereof I have to this codicil set my hand and seal this fourteenth day of December one thousand eight hundred and thirty one
