Will of William Toye of Thurlestone

This is my last Will and Testament. I William Toye of the parish of Thurlestone in the County of Devon do make this my last Will and first I give unto my Son Henry Anlaby Toye All my Stock Such as room and the Clock in the Staircase and also the Estate called Court Parks by paying the Debt thereon And my Will is that my two daughters Elizabeth Mary Shepherd Toye and Susan Ellen Toye shall have at their mothers death One hundred pounds each now insured in the Atlas [?] Office, J. H. Square Esqr of Kingsbridge Solicitor Agent for the same to be divided at their Mothers death between them share and share alike and altho the Policie of Insurance is now in the hands of the Mortgage of Court Parks it is not to remain there as there is Five hundred pounds insured on H. A. Toye's life for a security for the same but should not the policie be taken from him by law my Will is that my Son Henry Anlaby Toye shall sell Cort Parks to pay the Debt taking the remaing part for himself by paying his two Sisters One hundred pounds each And my Will is that at there Mothers death my two Daughters above mentioned shall have All the household furniture and plate to be divided between them share and share alike And my Will is that my two Grand Children Fredrick William Stokes and Ellen Stokes shall have Twenty five pounds each of the remaining part of the policie above mentioned for their sole use to be put in some Fund for them by their Uncle H. A. Toye untill they arrive to they age of twenty one years And if either of them should happen to die before the arrive to that age the remaining one to have the whole for his or her use alone And my Will is that my Son Francis Shepherd Toye shall have twenty five pounds And my Son in law Frederick John Stockes shall have Ten pounds from the Hundred pounds that is due from the Insurance to be paid to them within twelve months after their Mothers death And my Will is that my wife Elizabeth Margretta Toye shall have the residue and do make her my sole Executrix and to have at her disposal All the Corn growing or in ricks or barns for the first year after my death to pay the debts that may be demanded of her and to pay my funerall expences. This is my Will written with my own hand this twenty fourth day of January: One thousand eight hundred and sixty two_William Toye (Seal)

In Her Majesty's Court of Probate The District Registry at Exeter In the Goods of William Toye deceased. I John Snowdon of Thurlestone in the County of Devon Carpenter make Cam [claim?] and say that I am one of the subscribing Witnesses to the last Will and Testament of the said William Toye late of Thurlestone in the County of Devon Yeoman deceased the said Will being now produced to me and now hereunto annexed bearing date the twenty fourth day of January One Thousand eight hundred and sixty two and that the said deceased executed the said Will on the day of the date thereof by signing his name at the foot or end thereof as the same now appears thereon in the presence of me and of Bettsey Whidon of Thurleston aforesaid Widow the other subscribed Witness thereto, both of us being present at the same time, and we thereupon attested and subscribed the said Will in the presence of the said Testator and of each other____John Snowdon______Sworn at Newton Abbott in the County of Devon on the twenty eighth day of February 1863 before me___W.F. D'Arcy a Commissioner to administer Oaths in Chancery in England___________________________

On the 28th day of March 1863 the Will of William Toye late of Thurlestone in the County of Devon, Yeoman, deceased, was proved by the Oath of Elizabeth Margretta Toye, Widow, the Relict of the deceased, the sole Executrix, she having been first sworn duly to administer Effects under £1000.
