Will of John Norrish, Yeoman of Upton Pyne

In the Name of God Amen John Norrish of Upton Pyne in the County of Devon Yeoman make this my last Will and Testament I resign my Soul to its Creator in all humble hope of its Eternal Happiness as in the disposal of a Being infinitely Good My ffuneral I leave to the care of my Executrixes hereinafter named requesting only that a Sermon may be preached at my ffuneral As to my Worldly Estate I give and dispose thereof as follows ffirst I give and devise All that my Messuage Tenement and Lands called Dunsaller situate in the Parish of Thorverton in the County of Devon with the rights Members Hereditaments and Appurts thereunto belonging unto my Brother Robert Norrish for the term of fforty Years if he shall so long happen to live And from and after the End or sooner determination of the said term I give the said Messuage Tenement Lands Hereditaments and Premises with the Appurtenances unto Robert Norrish son of John Norrish of Exeter Baker my Nephew for and during the term of his natural Life And from and immediately after the end or determination of that Estate I give the same Premises with the Appurtenances unto Gregory Osmond of Newton St Cyres Yeoman and to his Heirs during the Life of the said Robert Norrish the son of John Upon Trust to support and Preserve the contingent remainder herein after limited from being defeated or destroyed and for that purpose to make Entries and bring Actions as Occasion shall require Nevertheless to permit and suffer the said Robert Norrish the Son of John and his Assigns to receive and take the Rents Issues and Profits of the said Premises during his Life And from and after the end or sooner determination of the said term of fifty years and death of the said Robert Norrish the Son of John I give and devise the said Messuage Tenement Lands and Premises with the Appurtenances unto and to the use of the first Son of the Body of the said Robert Norrish the Son of John lawfully to be begotten severally and successively and the Heirs Male of the Body of such first Son lawfully issuing And for default of such Issue Then to the use of the second third fourth fifth and every other Son and Sons of the Body of the said Robert Norrish the Son of John lawfully to be begotten severally and successively one after the other as they shall be in Seniority of Age and Priority of Birth and of the Heirs Male of the Body of such Son and Sons lawfully issuing the Elder of such Sons and the Heirs Male of his Body always to be preferred and to take before the Younger of such Son and Sons and the Heirs Male of his and their Body and Bodies issuing And for default of such Issue Then John I give and devise the said Messuage Tenement Lands and Premises with the Appurtenances unto and to the only and absolute use and behoof of my Niece Elizabeth the Wife of Thomas Densham of Upton Pyne Yeoman her Heirs and Assigns for ever Also I give and bequeath to my Nephew the said John Norrish the Sum of fifty Pounds to be paid to him at the end of six months next after my decease also I give unto Mary Hougood my Servant if living with me at the time of my decease the Sum of ffifteen Pounds as a token of my regard for her and in reward for her faithful services the same to be paid her at the End of One month next after my decease Also I give and bequeath unto my Niece Mary Norrish Daughter of my Brother Robert Norrish the Sum of foure shillings per week during her Life the same to be paid her Weekly as long as she lives by my Executrixes herein after named and their representatives out of my residuary Personal Estate Also I give and bequeath unto Robert Norrish Alice Mary and Agnes Norrish Son and Daughters of my said Nephew John Norrish by his first Wife the Sum of One hundred Pounds apiece to be paid to them when and as they shall severally attain their respective Ages of twenty one Years And in case any or either of them shall happen to die under that Age then the Legacies of him her or them shall belong and go and be paid to the Survivors or Survivor of them when and as the Original Legacy or Legacys of such Survivors or Survivor will become payable and all the rest residue and Remainder of my Goods Chattels Money Securities for Money Personal and Testamentary Estate whatsoever and wheresoever I give and bequeath unto my Sister Mary Maunder and my said Niece Elizabeth Densham for their equal Benefit share and share alike And I hereby make ordain and appoint the said Mary Maunder and Elizabeth Densham joint Executrixes of this my Will In Witness whereof I have hereunto set my hand and seal this twenty fourth day of April in the year of our Lord One thousand seven hundred and seventy four John Norrish
