Estate Duty Office Will of Samuel Farrant of Westown in the parish of Hemyock, Gentleman (1839)

Proved in the Archdeaconry Court of Exeter, 10 December 1839 by Robert Farrant, yeoman, sole executor

This is the Last Will and Testament of me Samuel Farrant of West Town within the parish of Hemyock in the county of Devon, Gentleman being of a sound and disposing mind memory and understanding hereby revoking and making void all former Wills by me at any time heretofore made

First I give and bequeath unto my nephews Samuel Farrant, Robert Farrant, William Farrant, and Thomas Farrant (sons of my late brother John Farrant) and Richard Fry the sum of forty pounds each of lawful money of Great Britain. Also I give and bequeath unto my nieces Sarah Bowerman, Mary Farrant, Betsy Farrant, Ann Fry, Sarah Fry and Jane Fry the sum of thirty pounds each. Also I give unto Susanna Luttley (my wife’s niece) the sum of fifty pounds all of like lawful money all of which said all which said legacies I direct shall be deemed and taken to be vested legacies from the time of my death and shall be paid by my brother Robert Farrant, his Heirs or assignees out of the messuages, lands, hereditaments and, premises hereinafter devised to him six months the decease of my said wife without interest. 

Also I give and devise unto my said dear wife Betty Farrant all that part of the dwelling house wherein I now reside consisting of the five parlours, two chambers or rooms over the same, the little cellar with the liquors and casks that may be therein at the time of my decease, the left side of the little couvert, the little garden and privy and all that part of the large garden lying on the left side of the Green Walk together with liberty for herself, workmen, friends visitors, servants and others having business to come go pass and repass at all times from the front court to the said parlours court cellar and gardens and also a like right of passage at all times from the said front court thro the entry and best kitchen belonging to my said dwelling house to the said parlours, rooms, cellar and gardens for and during the term of her natural life she keeping the same in good and tenantable repair 

And from and after her decease I give and devise the same unto my said brother Robert Farrant, his heirs and assignees for ever. 

Also I give and bequeath unto my said wife Betty Farrant such part of any household goods, plate and furniture as she shall make choice of and not exceeding in value one hundred pounds to and for her own absolute use and benefit. 

Also I give and bequeath unto my said wife Betty Farrant the sum of five hundred pounds of like lawful money to be paid to her by my said brother Robert Farrant, his heirs or assignees in one year next after my death. 

Also I give and bequeath unto my said wife Betty Farrant and her assignees for and during her natural life one annuity clear yearly rent or annual sum of seventy pounds of like lawful money free and clear of and from all taxes and deductions whatsoever parliamentary or otherwise, the said annuity to be charged and chargeable on and issuing and payable out of the Lands Hereditaments and Premises hereinafter given and devised unto my said brother Robert and to be paid and payable by him by four even and equal quarterly payments that is to say Christmas day, Lady day, Midsummer day and Michaelmas day, the first payment thereof to begin and be made on the first of the said days as shall first and next happen after my decease with the usual power of distress and entry on non payment as is usual in cases of distress or rent and which said annuity I will and direct shall be accepted and taken by my said wife in full compensation satisfaction and discharge of all devises and thirds at Law which she may be entitled unto out of any messuages Lands Tenements or Hereditaments of which I may die seized. 

Also I give and bequeath unto my sister Sarah Fry and her assignees for and during the term of her natural life one annuity clean yearly rent or sum of fifteen pounds of like lawful money free and clear of and from all taxes and deductions whatsoever parliamentary or otherwise the same to be charged and chargeable on and issuing and payable out of my said Lands Hereditaments and premises hereinafter given and devised unto my said brother Robert and to be paid and payable by him by four even and equal quarterly that is to say Christmas day, Lady day, Midsummer day and Michaelmas day the first payment thereof to begin and be made on the first of the said days as shall first and next happen after my decease with the like power of distress and entry on non payment as is usual in cases of distress for rent.

Also I give and devise unto my sister Margaret Farrant and her assignees for and during the term of her natural life one annuity clean yearly rent or sum of fifteen pounds of like lawful money free and clear of and from all taxes and deductions whatsoever parliamentary or otherwise the same to be charged and chargeable on and issuing and payable out of my said Lands Hereditaments and premises hereinafter given and devised unto my said brother Robert and to be paid and payable by him by four even and equal quarterly that  is to say Christmas day, Lady day, Midsummer day and Michaelmas day, the first payment thereof to begin and be made on the first of the said days as shall first and next happen after my death with the like power of distress and entry on non payment as is usual in cases of  distress for rent.

Also I give and bequeath unto my sister Edith Farrant and her assignees for and during the term of her natural life one annuity clear yearly rent or sum of fifteen pounds of like lawful money free and clear of and from all taxes and deductions whatsoever parliamentary or otherwise the same to be charged and chargeable on and issuing and payable out of my said Lands Hereditaments and premises hereinafter given and devised unto my said brother Robert and to be paid and payable by him by four even and equal quarterly payments that is to say Christmas day, Lady day, Midsummer day and Michaelmas day, the first payment thereof to begin and be made on the first of the said days as shall first and next happen after my death with the like power of distress and entry on non payments is usual in cases of distress for rent.

 Also I give and devise unto my said brother Robert Farrant all those Messuages tenements farms Closes Lands hereditaments and premises commonly called West town and Hurrels (subject nevertheless to the estate for life of my said wife to said part of the said dwelling house court gardens and premises) containing about one hundred acres situate in Hemyock aforesaid and now in my occupation. Also all that messuage tenement closes lands and premises situate also in Hemyock and which I some time since purchased of my nephew John Fry and now in possession of the said Richard Fry as my tenant. Also all those my three closes of land situate on Hackpen hill also in Hemyock aforesaid. Also all other any messuages tenements closes lands Hereditaments and premises  of what nature or kindsoever situate in the said parish of Hemyock or elsewhere And all my personal estate (except as aforesaid given to my said wife) to hold the same and every part thereof unto my said brother Robert Farrant his heirs executors administrators and assignees for ever to whom I give the same subject and charged nevertheless to and with the payment of the aforesaid four several annuities so given to my said Wife and Sisters aforesaid. Also to the said legacy of five hundred Pounds given to my said wife the Fifty pounds to her said niece and the said eleven legacies so given to my said Nephews and nieces as aforesaid. And also to and with the payment of the Sum of Three Hundred and Sixty pounds to each of my said Sisters Margaret and Edith due from me to them on my Promissory Notes and in discharge thereof and the sum of One hundred Pounds due from me to my Sister Sarah Frys Trustees on my promissory note and in discharge thereof and all other my just Debts and funeral expenses.

And I do hereby make nominate constitute and appoint my said brother Robert Farrant Sole Executor and Residuary Devisor of this my Will. 

In Witness whereof I the said Samuel Farrant the Testator have to this my last Will and Testament comprised in and written on four sheets of paper (affixed and sealed together) set my hand to three first sheets thereof and my hand and seal to the fourth and last this sixteenth day of November in the year of our Lord 1835

Signed Sealed published and declared by the said Samuel Farrant the Testator as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses thereunto
