Will of Thomas Hogg, of Appledore, 1835

Transcriber’s notes:

Thomas Hogg was baptised on 20 Jan 1774 at Northam Parish Church, the son of Thomas Hogg and Elizabeth (nee Irwin).

He married Elizabeth Vaughin at Instow in March 1800, by which he had two children:
i) Thomas Chichester Hogg, 1801, probably died between 1825 and 1835
ii) William Augustus Hogg, 1803, died aged 1 month

At the age of 61 he had a child by his ‘mistress’, Sarah Dimond
    i) Thomas Howard Effingham Hogg Dimond, 1835
    (after this Will, he became Thomas Howard Effingham Hogg Dimond Hogg).

This Will was written 03 October 1835.
He was buried at Northam on 14 October 1835.
The Will was proved on 24 November 1835.

Will:

This is the last Will and Testament of me, Thomas Hogg of Appledore in the parish of Northam in the County of Devon, esquire.

I give and bequeath unto John Hogg of Bideford in the said County, druggist, one hundred pounds [£100] of lawful English money.

I give unto Samuel Barrett of Bideford aforesaid, stationer, one hundred pounds [£100] of like lawful money. And I direct that my said legacies shall be paid by my executors at the expiration of twelve months next after my decease.

All the rest, residue and remainder of my lands, tenements and hereditaments, money, securities for money, goods, chattels and effects, and all other my real and personal estate of what nature kind or quality soever, I give, devise and bequeath unto, and to the use of William Turton of Bideford aforesaid, Doctor of Medicine, the said Samuel Barrett, and Hugh Balmont of Barnstaple in the said County, surveyor, upon trust as to my said real estate to convey the same to my natural son Thomas Howard Effingham Hogg Dimond, son of Sarah Dimond, singlewoman, when and as soon as he shall attain the age of twenty one years.

And in the mean time, to advance such sums as may be necessary for the maintenance and education of the said Thomas Howard Effingham Hogg (but subject nevertheless to the annuity hereinafter mentioned) and as to my said personal estate and effects, upon trust to pay and discharge all my just debts, legacies, personal and testamentary expenses, and after payment thereof, to assign, deliver or pay over the same unto the said Thomas Howard Effingham Hogg when he shall attain the age of twenty one years.

And I hereby declare my will to be that in case the said Thomas Howard Effingham Hogg shall die before he attains the age of twenty one years, then I direct my said trustees to convey, assign, pay over, or deliver the said real and personal estate to Thomas Hogg, son of the said John Hogg, his heirs, ex[ecut]ors administrators or assigns.

I give unto the said Sarah Dimond an annuity of thirty pounds [£30] during her life, to be paid to her half yearly, and I charge that my said real estate with the payment thereof, and I give under the said Sarah Dimond the usual powers of distress and entry for recovering the same, as if the said annuity was reserved wher by indenture of demise or lease at racke rent.

I appoint the said William Turton, Samuel Barrett and Hugh Balmont executors of my Will and give to them all the usual and customary powers with which trustees and executors are necessarily clothed.

Witness my hand this third day of October one thousand eight hundred & thirty five [03 Oct 1835]. 

I give unto Mary Spencer my servant five pounds [£5], to John Gould my servant ten pounds [£10], George Dalway of Bideford hair dresser five pounds [£5], the said legacies to be paid at the expiration of twelve months after my death.

This my express desire that the said Thomas Howard Effingham Hogg Dimond do take and [k]noe the name of Hogg in addition to his other name, and in default of this so doing when it can be legally effected.

I direct my said trustees to convey, assign, pay over, and deliver my said real & personal estate and effects to the said Thomas Hogg, son the said John Hogg, his heirs, ex[ecut]ors or adm[inistrat]ors.

Proved at London 24th Nov[ember] 1835 before the Judge by the oaths of William Turton, Samuel Barrett and Hugh Ballment (in the Will written “Balmont”) the executors to whom adm[inistrati]on was granted having been first sworn by Common duly to administer.
